NOTIFICATION
New Delhi, the 1st September, 2025
S.O. 3999(E).—In exercise of the powers conferred by sub-section (1) of section 25 of the Immigration and
Foreigners Act, 2025 (13 of 2025), the Central Government hereby specifies the officer or authority as mentioned in
column (4) of the Table, who may, before institution of any prosecution under the said Act or during trial, compound
the offences under the said Act as specified in column (2) of the said Table, on payment of the sum (amount) as
specified in column (3) of the said Table

| 2. | 23. Whoever, — (a) being a foreigner, remains in any area in India for a period exceeding the period for which the visa was issued to him or stays in India without a valid passport or other valid travel document in contravention of provisions of section 3 or does any act in violation of the conditions of the valid visa issued to him for his entry and stay in India or any part thereunder; (b) contravenes any other provisions of this Act, other than sections 17 and 19, or of any rule or order made thereunder or any direction or instruction given in pursuance of this Act or such order or direction or instruction for which, no specific punishment is provided under this Act, shall be punishable with an imprisonment for a term which may extend to three years or with a fine which may extend to three lakh rupees or with both. | | |

| | (vii) Non-submission of information in respect of foreigners admitted by a University or Educational Institution or any other institution admitting a foreigner for education in contravention of the provisions of section 9 of the Act or rule 16 of the Immigration and Foreigners Rules, 2025. | One lakh rupees in each case. | Foreigners Regional Registration Officer. |
| | (viii) Non-submission of information in respect of foreigners taking indoor medical treatment or their attendant for whom lodging or sleeping facility has been provided by a hospital, nursing home or any other such medical institution providing such facility in contravention of the provisions of section 10 of the Act or rule 18 of the Immigration and Foreigners Rules, 2025. | One lakh rupees in each case. | Foreigners Regional Registration Officer. |
| | 24. (1) Whoever abets any offence punishable under sections 21, 22 or 23 shall, if the act abetted is committed in consequence of the abetment, be punishable with the same punishment as provided for those offences. | Same sum (amount) as that of an offence abetted. | Foreigners Regional Registration Officer. |
| | (2) For the purposes of this section,– (i) an act or offence is said to be committed in consequence of the abetment, when it is committed in consequence of the instigation, or in pursuance of the conspiracy, or with the aid which constitutes the offence; (ii) the expression "abetment" shall have the same meaning as assigned to it under section 45 of the Bharatiya Nyaya Sanhita, 2023 (45 of 2023). | | |
| 2. | This notification shall come into force on the date of its publication in the Official Gazette. | | |
