The Ministry of Railways, South Central Railway, issued S.O. 3468(E) dated 2nd August 2023 at Secunderabad, referencing its earlier notification S.O. 1874(E) dated 25th April 2023 (published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii), dated 25th April 2023), issued under sub-section (1) of Section 20A of the Railway Act, 1989 (24 of 1989) and the Railway (Amendment) Act, 2008 (11 of 2008), declaring the Central Government's intention to acquire land for the Special Railway Project, namely the Khandwa Akola Gauge Conversion (MG to BG), in Madhya Pradesh; the substance of that notification was published in Dainik Bhaskar (Hindi) and Patrika (Hindi) on 5th May 2023 by Hemant Kumar Bhagoria, Chief Engineer-V, Construction Organization, Secunderabad, under sub-section (4) of Section 20A; one objection concerning Dasghat village, Burhanpur district, was received by the Sub Divisional Magistrate (Revenue) and Competent Authority, Nepanagar (Madhya Pradesh), and was disposed of by filing the case; pursuant to sub-section 20E, the Competent Authority submitted its report, and the Central Government now declares, under sub-section (1) of Section 20E, that the land in the Schedule shall be acquired for the aforesaid purpose, and, under sub-section (2) of Section 20E, that on publication the land vests absolutely in the Central Government free from all encumbrances; the Schedule covers Village Dasghat, Burhanpur district, comprising Khasara No. 72 (0.4300 hectares, irrigated, owner Lakhan S/o Ramarao) and Khasara No. 74 (0.1400 hectares, irrigated, multiple named co-owners), a total acquired area of 0.5700 hectares [F. And whereas, the substance of the said notification was published in daily newspapers namely “Dainik Bhaskar (Hindi)” & “Patrika (Hindi)” on 5th May 2023 by Hemant Kumar Bhagoria Chief Engineer -V, Construction Organization Secunderabad under sub section (4) of section 20A of the said Act; And whereas, for Dasghat village of Burhanpur District, 01 objection received to the Sub Divisional Magistrate (Revenue) and competent Authority, Nepanagar (M.P.); Which have been disposed of by filing case. And whereas, in pursuance of sub -section 20E of the said Act, the competent authority has submitted its report to the Central Government; Now therefore, upon receipt of the report of the Competent Authority and in exercise of the powers conferred by sub-section (1) of section 20 E of the said Act, the Central Government hereby declares that the lands specified in the schedule annexed hereto shall be acquired for the aforesaid purpose; And further, in pursuance of sub-section (2) of section 20E of the said Act, the Central Government hereby declares that on publication of this notification in the official Gazette, the land specified in the schedule annexed here to shall vest absolutely in the Central government free from all encumbrances.
