Eligibility criteria require applicants to meet Scheme parameters, furnish a Bank Guarantee within 30 days of approval valid for at least 6 years, comply with FDI Policy 2020, and not be listed as defaulters, willful defaulters, SEBI debarred, or subject to insolvency proceedings. The application process involves online and hard copy submission to MHI with a non-refundable fee of ₹ 5,00,000. An inter-ministerial Scheme Sanctioning Committee (SSC), chaired by the Secretary, MHI, is constituted for monitoring. Applicants can avail lower customs duty benefits up to the defined limit by obtaining an annual import certificate from MHI based on an annual import application reviewed by the Project Management Agency (PMA), IFCI Limited. Monitoring includes periodical reviews, document verification, site inspections, and quarterly reports (QRR). Commencement of operations must be within 3 years of approval, with minimum revenue targets of ₹ 5,000 crore by Year 4 and ₹ 7,500 crore by Year 5, subject to penalties for non-compliance. Domestic Value Addition (DVA) certification follows PLI Auto Scheme SOPs, with minimum DVA targets of 25% within 3 years and 50% within 5 years. MHI holds powers to amend guidelines and resolve operational issues. Disputes are resolved by MHI, with jurisdiction in New Delhi Courts/Tribunals. Violation of Scheme/Guidelines results in automatic invocation of the bank guarantee. An Integrity Pact undertaking is mandatory.

Background 1.1. The Government of India vide notification S.O. No. 1363(E) dated 15th March 2024 has notified the Scheme to Promote Manufacturing of Electric Passengers Cars in India (herein referred to as "SPMEPCI” or “the Scheme") to attract investments from global electric passenger car manufacturers, generate employment opportunities, achieve the goal of "Make in India" and promote India as a manufacturing destination for electric passenger cars. 1.2. Department of Revenue, Ministry of Finance, also issued notifications nos. 19/2024-Customs & 20/2024- Customs dated 15th March 2024 for reduced import duties in line with the provisions of the Scheme. 1.3 In pursuance of paragraph 12.4 of the Scheme and for effective and smooth implementation of the Scheme, the following guidelines are being laid down supplementary to the provisions specified in the Scheme. Efforts have been made to ensure that these guidelines are aligned with the provisions of the Scheme. However, in the event of any inconsistency, the provisions of the Scheme notification shall prevail. 2. Definitions This section defines terms used in the guidelines of the Scheme in addition to the terms already defined therein: 2.1. Application Form: It is the form required to be filed by the Applicant along with uploading of supporting documents on the online portal of MHI. The format of Application Form is provided in Annexure-I for reference purpose. A hard copy of the application along with all annexures will also be submitted to MHI. In case of any discrepancy between the information submitted online and the hard copy, the information submitted online shall prevail while evaluating eligibility under the Scheme. 2.2. Chartered Engineer: Engineers having corporate membership of the Institute of Engineers (India) and having Chartered Engineer (India) certificate issued by the Institution of Engineers (India) and empanelled with the PМА. 2.3. Committed Investment: The total investment committed to be made by an Applicant under the Scheme, at the time of submitting the Application. The committed investment should be a minimum of ₹ 4,150 crore. Provided further that there is no bar on the Applicant from making investment beyond the minimum committed investment. However, the total duty to be foregone shall be limited to lower of ₹ 6,484 crore or the Investment made under this Scheme. 2.4. Date of Commencement of Operations: The date of commencement of operations shall be reckoned from the date of first commercial sale invoice of the Eligible Product manufactured from the Investment made under the Scheme. 2.5. Duty Foregone: It is the financial benefit to the Approved Applicant on account of import of e-4W made during the tenure of the Scheme as the difference of: (a) Amount of Customs duty (including basic customs duty, integrated goods and services tax (IGST), social welfare surcharge (SWS) or any other customs duty, if applicable) as applicable on the import of CBUS of electric passenger cars under the Customs Tariff Act, 1975 as amended from time to time and section 110 of the Finance Act, 2018 as amended from time to time and; (b) Amount of Customs duty as per para 2.5.(a) above, reduced after taking effect of Notification No. 19/2024- Customs and Notification No. 20/2024- Customs dated 15th March 2024. Illustrative examples for calculating Duty Foregone are provided at para 2.8. 2.6. Electric Passenger Car/Vehicle (e-4W): shall refer to category M-1 Battery Operated Vehicle (BOV), as defined under clause 2(t) and 2(u) of Central Motor Vehicles Rules, 1989. 2.7. E-4W permitted for import: means electric passenger cars manufactured by global Group Companies which are proposed to be imported by the Approved Applicant and approved for sale in India as per relevant statutory regulations. 2.8. Maximum number of E-4W permitted for import: The maximum number of EVs to be imported under this Scheme shall be such that the Total Duty Foregone will be limited to the lower of the following: a. The maximum duty foregone per applicant (limited to ₹ 6,484 crore), or b. Independent Auditor/ Statutory Auditor: An auditor as appointed under Section 139 read with Section 141 of the Companies Act, 2013. In case of joint auditor appointment in the company, any one of such joint Auditors shall be treated as Independent Auditor. 2.10. Total Duty Foregone: It is the cumulative Duty Forgone for import of e-4Ws under the Scheme, which shall be restricted to the lower of the following: a) Committed Investment, or ₹ 6,484 crore 3. Investment 3.1. Investment made and capitalized in the books of accounts of the Approved Applicant on or after Application Approval Date will only be considered under the Scheme. 3.2. Invoice for Investment shall be issued in the name of the Approved Applicant only and no invoice for any expenditure, issued in the name of vendor/supplier(s), Group Company(ies) or related party(ies) or any other third party(ies) would be considered for ascertaining fulfilment of Committed Investment. 3.3. Investment should be made for domestic manufacturing of Eligible Product. In case the Investment under the Scheme is made on brownfield project, a clear physical demarcation with the existing manufacturing facility(ies) should be made. 3.4. The Investment to be made under the Scheme must be confined to the Approved Applicant's plant location only. However, charging infrastructure set up by the Approved Applicant can be located at various locations in India. Further, tools, dies, moulds, jigs & fixtures may be located at supplier's premises. 3.5. Following are the clarifications regarding investment in charging infrastructure and design (ER&D) : 3.5.1. Charging Infrastructure: a) Charging infrastructure established must be compliant with Ministry of Power (MoP) guidelines issued vide No. 12/2/2018-EV dated 17th September 2024 on the subject “Guidelines for Installation and Operation of Electric Vehicle Charging Infrastructure-2024" and as amended from time to time. b) Investment for charging infrastructure under the Scheme would be eligible only to the extent attributable to earth embedded public charging stations made for e-4W having fast charging facility as defined under guidelines issued by Ministry of Power vide No. 12/2/2018-EV dated 17th September 2024 and as amended from time to time. c) Expenditure incurred on charging infrastructure would be considered upto maximum 5% of the Committed Investment. 3.5.2. Engineering Research and Development (ER&D) (In House): a) Expenditure on design shall include expenditure on in-house and captive Engineering Research and Development (ER&D) and product design & development related to the Eligible Product. The term "related" here refers to all stages in the entire value chain of the goods proposed to be manufactured including software integral to the functioning of the same. b) This expenditure shall further include test and measuring instruments, prototypes used for testing, purchase of design tools, software cost (directly used for ER&D) & license fees, expenditure on technology & transfer of technology (ToT) agreements including the purchase of technology, IPR, Patents and copyrights for ER&D, subject to all relevant documents for the same being submitted to Project Management Agency (PMA)/MHI. c) One-time cost of IPRs including know how, patents, copyrights, etc. shall only be considered for determining fulfillment of Committed Investment. It is hereby clarified that any such recurring expenditure by way of royalty, paid by whatever name called, shall not be considered as part of the Committed Investment. d) Sub-contracting is not allowed for ER&D under the Scheme. However, the professional services of technical personnels could be availed for undertaking in-house ER&D which should be capitalized in the financial statements of the Approved Applicant. e) In the case of ER&D, expenditure capitalized in the books of accounts shall only be considered for determining fulfillment of Committed Investment. 3.6. Following is the list of particulars which shall remain excluded from the Investment under the Scheme: a) Land b) Building other than of main plant and utilities c) Royalty d) Recurring expenses on IPRs including patents, know-how, copyrights, trademarks, etc. e) Administrative/ hostel building/ staff quarters f) Interest during construction (IDC), pre-operative and administrative expenses g) Slump sale/ second hand machinery/ refurbished machinery h) Creditable taxes and duties (such as GST) even if not availed in GST returns i) Investments made under other PLI/ Incentive Schemes of Government of India j) Revenue expenses k) Leased Assets 1) Capital work in progress 3.7. For the purpose of determination of reasonableness and verification of Investment of the Approved Applicant, separate SOPs will be issued by MHI/PMA. 4. Eligibility criteria for the Applicant(s) 4.1. The Applicant shall meet the eligibility criteria as defined in para 4.1. of the Scheme and submit bank guarantee as provided in para 4.2. of the Scheme. 4.2. Bank Guarantee (BG): The Bank guarantee to be furnished should fulfil following criteria: a) Bank Guarantee should be an unconditional, irrevocable Bank Guarantee issued from a scheduled commercial bank in India. b) It should be submitted within 30 days from the Application Approval Date, having validity of at least 6 years at the time of submission. c) The Bank Guarantee should be valid at all times during the tenure of the Scheme. The format of Bank Guarantee is as per Annexure-II-A. Further an undertaking in format as per Annexure-II-B is also to be furnished along with the BG. 4.3. Foreign (non-resident) investment in the Approved Applicant shall be in compliance with the FDI Policy 2020 as amended from time to time or the subsequent FDI policy issued thereafter, if any. The Applicant shall submit an Undertaking (format as per Annexure-III) that they are eligible under the said FDI Policy or as amended from time to time. 4.4. Revenue/ investment/ net worth of individual promoters of the Companies/ Group Companies will not be considered under the Global Group Revenue/ Global investment, respectively, for eligibility under the Scheme. 4.5. If the Global Group Revenue and Global investment of the Applicant (including Group Companies) is available in a currency other than Indian National Rupee (*), the Indian currency equivalent amount may be computed by applying an average of the exchange rate notified by the Reserve Bank of India as on the first day and last day of the reporting period. 4.6. Revenue and global investment in gross block of fixed assets of Applicant and Group Companies whose figures have been considered for determining the eligibility are to be furnished on Statutory Auditor Certificate by the Applicant. The format of Statutory Auditor certificate of Global Group Revenue and Global investment for Group Companies is as provided in Annexure-IV. 4.7. The Applicant(s) whose accounts are considered Non-Performing Asset (NPA) as per RBI guidelines or defaulter or willful defaulter as per RBI/CIBIL or SEBI debarred list or reported as fraud by any bank, financial institution or non-banking financial company, would be considered as ineligible. Further, there should not be any insolvency proceedings admitted against the Applicant in the National Company Law Tribunal (NCLT). 4.8. The Group Companies whose financials are being considered for determining eligibility should also not have been declared defaulters. Further, a certificate from Company Secretary of the Applicant confirming that the Applicant and its Group Companies have not been declared as defaulter/ wilful defaulter/ reported as fraud by a bank, financial institution or non-banking financial company/ admitted for insolvency proceedings/ debarred by any securities or financial sector regulator, is to be furnished. The format of the certificate to be provided by Applicant and its Group Companies registered in India is as provided in Annexure-V-A and the format of certificate to be provided by Group Companies registered outside India is as provided in Annexure-V-B. Such certificate needs to be re-submitted annually and on every update in the status of the Applicant or its Group Companies in this regard. 5. Application Procedure 5.1. The Applicant is required to submit the Application Form along with financial & supporting documents. The application along with other supporting documents should be certified by the authorised representative of the Applicant who has been duly authorised by the Board of Directors of the Applicant. The format for obtaining approval of the Board of Directors is at Annexure-VI. 5.2. A non-refundable application fee₹ 5,00,000/- will be payable by the Applicant at the time of filing the Application Form. The details of the bank account for remittance of the application fee and related terms & conditions shall be same as provided in the Application Form. The application fee would be accepted electronically only. 5.3. Applications will be liable for rejection at any stage, if it is found that incorrect information having a bearing on the selection of the Applicant was furnished in the Application. 5.4. Upon successful submission of an application, PMA will issue a unique Application ID to the applicant for all future references pertaining to the Scheme. 5.5. A hard copy of the application along with all annexures is also required to be submitted to MHI on or before the last date of submission. The hard copy shall be submitted to Director, MHI, Room no. 218, Udyog Bhawan, New Delhi – 110001. 5.6. After receiving approval from MHI, the PMA will arrange to issue a letter to the Approved Applicant within 5 working days, communicating approval under the Scheme. 6. Scheme Sanctioning Committee (SSC) 6.1. An inter-ministerial Scheme Sanctioning Committee chaired by Secretary, MHI will be constituted for sanctioning, overall monitoring and implementation of the Scheme as well as to remove any obstacles/ difficulties that may arise in the implementation stage. The Composition of the Committee will be as follows: (a) Secretary, MHI (Chairman) (b) CEO, NITI Aayog (c) Secretary, Department of Revenue (DoR) (d) Secretary, Department of Economic Affairs (DEA) (e) Secretary, Ministry of Commerce & Industry (MoCI) (f) Secretary, Department for Promotion of Industry and Internal Trade (DPIIT) (g) Secretary, Ministry of Road, Transport & Highways (MoRTH) (h) Secretary, Ministry of Power (MOP) (i) Financial Advisor, MHI (j) Director, ARAI (k) Additional/Joint Secretary, MHI (Member Secretary) The Committee may co-opt any other member as and when required. 7. Procedure to avail lower Customs duty benefit 7.1. Under the present Scheme, the Government of India shall, at the outset, provide to the Approved Applicant customs duty waiver to the extent of the Committed Investment or Rs. 6,484 crore, whichever is lower, in the manner set out herein. 7.2. As per Notification No. 19/2024 and 20/2024- Customs dated 15 March 2024, in order to avail duty benefit under the Scheme, the Approved Applicant is required to furnish a certificate from an officer not below the rank of a Joint Secretary to the Government of India in MHI to the effect that, - (i) the importer holds a valid Approval Letter issued by the Ministry of Heavy Industries under the 'Scheme to promote manufacturing of electric passenger cars in India' notified vide S.O. No. 1363 (E) dated 15th March, 2024, by the Ministry of Heavy Industries; (ii) the importer satisfies the conditions of the aforesaid scheme and the quantity of the vehicles being imported is within the limits prescribed in Para. 1.3.5 and para. 1.3.6 of the aforesaid Scheme; and (iii) the importer is eligible for grant of this exemption in respect of the goods being imported. 7.3. For issuance of import certificate by MHI, the Approved Applicant would be required to furnish an annual import application to PMA for number of e-4Ws proposed to be imported in the next 12 months under the Scheme. The said annual import application has to be submitted within 30 days of the Application Approval Date for the first year and subsequently, at least 60 days prior to commencement of each year for which the approval is required. The format of the annual import application to be furnished is as provided in Annexure- VII. The Applicant will have an option to submit a revised annual import application, if required, with proper justification. This option to submit a revised annual import application can be exercised only once during a year. 7.4. After the first year, the Approved Applicant would, along with the annual import application, be required to furnish a certificate duly certified by Chartered Engineer certifying inter-alia the following: a. Investment made till date (purchase orders issued, expenditure incurred and amount capitalized) b. Whether the Investment and construction made is in line with the business/ project plan submitted at the time of application (as per Annexure-VIII) c. Photos of manufacturing facility(ies) taken during site visit d. Details of assets lying at supplier's premises e. Any other document(s) which seems necessary to the Chartered Engineer or as may be specified by MHI/PMA. 7.5. The annual import application and Chartered Engineer certificate submitted by the Approved Applicant would be reviewed by PMA. The PMA may also cross check the information with that available with the Customs authorities in India. PMA would, accordingly, put up its recommendation to MHI for the issuance of the annual import certificate. 7.6. MHI would review the recommendation of the PMA and if satisfied, MHI would issue annual import certificate for the Applicant. 8. Monitoring 8.1. Post issuance of the approval letter, PMA shall monitor the progress of the Approved Applicant(s). 8.2. Periodical review will be done by MHI to monitor progress under the Scheme. 8.3. The Applicant would be required to maintain and produce all original documents including original invoices, bills of entry (for imported items), bank account statements, etc. for the purpose of verification by MHI/PMA or any other agency authorised by MHI/PMA. 8.4. The MHI/PMA either on its own or through a certified third party shall have the right to carry out physical inspection of an Applicant's manufacturing unit(s) and office(s) through site visits for the purpose of verification and preparation of verification report. 8.5. In case of any doubt with respect to determining eligibility and benefit due, or any other matter in discharge of its duties and responsibilities, the PMA may refer such matter to MHI for clarification. 8.6. If the PMA or MHI is satisfied that eligibility under the Scheme and / or benefits availed under the Scheme have been obtained by misrepresentation of facts or falsification of information, MHI will ask the Approved Applicant to refund any benefit obtained under the Scheme along with interest calculated at 3 years' SBI Marginal cost of funds-based lending rate (MCLR) prevailing on the dates of availing benefits, compounded annually, after giving an opportunity to the applicant of being heard. This will be in addition to MHI's right to take any other action as deemed fit. 8.7. Any change / deviation in the location of a project / unit shall be allowed after obtaining approval from MHI. For the aforesaid purpose, the Applicant would submit the revised project plan along with the reason for change of location which PMA would verify and if satisfied with the genuineness of the change, would forward the application along with their recommendation to MHI for approval. The decision made by MHI in this regard would be final. 8.8. The Approved Applicant would also be required to submit quarterly review report (QRR) to the PMA within 30 days from the end of each quarter on the progress being made in setting up manufacturing facilities in India during the scheme duration. The format of QRR is as provided in Annexure-IX. 8.9. Consent for audit/ verification of manufacturing sites, financial statements, import records and any other data related with the company's operations under the Scheme is to be provided in format as per Annexure-X. 9. Commencement of Operations and Minimum Revenue Criteria 9.1. The Date of Commencement of Operations shall be within 3 years from Application Approval Date. 9.2. DVA Certification & Role of Testing Agency(ies) 10.1. To assess the DVA of the Eligible Product as required under the Scheme, the Standard Operating Procedure (SOP) issued under Production Linked Incentive (PLI) Scheme for Automobile and Auto Component (PLI Auto Scheme) would be followed. 10.2. Certification of DVA of Eligible Product manufactured in India by the Approved Applicant would be done by testing agency(ies) of MHI. 10.3. Further, Techno-Commercial Audit (TCA) and Periodic Surveillance Audit (PSA) of DVA certified products would also be required in accordance with SOP for certification of DVA issued for PLI Auto Scheme. 10.4. The Approved Applicant would also be required to comply with the Central Motor Vehicles Rules, 1989 and all other regulations and guidelines applicable for motor vehicles for import of e-4W in India. 11. Powers of MHI to frame Guidelines/ Procedure 11.1. MHI shall have the powers to frame/ lay down the guidelines/ procedure or alter/ amend/add/delete any terms & conditions, etc. under this Scheme/ guidelines. 11.2. MHI/ PMA shall have the powers to call for any information/data/ records, etc. in connection with this Scheme or inspect such records/ information (manual or electronic) as it may deem necessary. 11.3. Approved Applicant should maintain all the relevant data/ documents/records for a time period specified under statutory provisions such as Income Tax Act 1961/ CGST Act/ General Financial Rules (GFR)/ Gol instructions/ tenure of this Scheme, whichever is higher. Applicants should refer to the aforesaid Acts/provisions, especially GFR for maintenance/ retention of documents. 11.4. MHI/ PMA shall have powers to depute its representative(s) to visit the premises/office/works/factory/ workplace, etc. for the purpose of inspection and verification and may pass such order or issue directions in relation thereto as it may deem fit. In case it is required to visit any unit(s) of Applicant's supplier(s), then the Applicant shall facilitate the same. 11.5. All operational issues in the implementation of the Scheme and guidelines shall be resolved by MHI and its decision will be final in all respects. 12. Resolution of Disputes 12.1. Any dispute under this Scheme shall be resolved by mutual discussion and reconciliation. In case of difference of opinion, decision of Additional/Joint Secretary, MHI shall be final. 12.2. The jurisdiction in respect of any disputes that may arise under this Scheme shall lie at the Courts/Tribunals in New Delhi, India only. 13. Violation of the Scheme or the Guidelines Any violation committed by the Approved Applicant to any of the conditions of the Scheme or the Scheme Guidelines, or any other directions issued by MHI/PMA from time to time, shall result in automatic invocation of the bank guarantee by MHI/PMA. 14. Integrity Pact 14.1. To obviate any malpractices in financial matters, it has been decided to provide deterrent against the corrupt practices for promotion of transparency and equity. Therefore, keeping in view the sensitivities involved in the process and taking cue from the instructions of the Central Vigilance Commission regarding adoption of an Integrity Pact in the matter of procurement, it has been decided that Applicants shall furnish undertaking w.r.t. Integrity Compliance duly signed by its authorised signatory, as will be issued along with the Application Form. The undertaking shall be provided by all the Applicants. The applications of those Applicants who do not submit the undertaking shall not be processed and considered. 14.2. The Integrity Pact would be required to be submitted by the Applicant(s) at the time of submission of application and thereafter along with each annual import application. The format of Integrity Pact Undertaking to be furnished is as provided in Annexure-XI. 15. Miscellaneous The Scheme notification and its guidelines can be reviewed and revised by the competent authority in MHI. The Guarantor hereby unconditionally and irrevocably guarantees the due and compliance of terms by the Approved Applicant of all its obligation under the said undertaking and Approval Letter, as amended from time to time. The Guarantor shall, without demur, pay to MHI/PMA sums not exceeding in aggregate ₹ (Rupees -----) within five (5) bank working days (as per the Reserve Bank of India) on receipt of a written demand thereof from MHI/ PMA stating that the Approved Applicant has failed to meet its obligations under the said undertaking. The Guarantor shall not have to go into the veracity of any breach or failure on the part of the Approved Applicant or validity of the demand so made by MHI/ PMA and shall pay the amount specified in the demand notwithstanding any direction to the contrary given or any dispute whatsoever raised by the Approved Applicant or any other person. The Guarantor's obligations hereunder shall subsist until all such demands are duly met and discharged in accordance with the provisions hereof; III. The Guarantor agrees that its liability under this guarantee shall in no manner be affected by any such variation, alteration, modification, waiver dispensation and that no further consent of the Guarantor is required for giving effect to any such variation, alteration, modification, waiver dispensation with or release of security; IV. This Guarantee shall be unconditional and irrevocable; and shall remain in full force and effect till (Bank Guarantee Period) (date cannot be lesser than 6 years from the date of submission to MHI/ PMA). The claim period for MHI to invoke the present Guarantee shall remain for another period of 1 year from the expiry of the Bank Guarantee Period i.e. till (Claim Period). We clearly understand from the Scheme that Bank Guarantee submitted by us could be invoked inter-alia on non- fulfilment of any of the following: (a) Investment of minimum ₹4,150 crore within a period of 3 years from the application approval date; (b) Electric Passenger Cars manufactured by us at our manufacturing facility(ies) in India will be required to achieve a DVA of minimum 25% within a period of 3 years from the application approval date; (c) Investment made by us within a period of 5 years from the application approval date should be at least equivalent to duty foregone, or USD 500 million, whichever is more; (d) Electric Passenger Cars manufactured by us at our manufacturing facility(ies) in India will be required to achieve a DVA of minimum 50% within a period of 5 years from the application approval date. (e) Conditions for import prescribed in the Notification No. 19/2024-Customs dated 15 March 2024 notified by Ministry of Finance. (f) Payment of penalty as specified in the Scheme Guidelines. (g) Adherence to directions given by MHI, from time to time, in connection with this Scheme. Further, misrepresentation, misstatements, misinformation, falsification of information with an intention to defraud the Government would also be a circumstance for invocation of bank guarantee. 5. Now, therefore, the Applicant including its officers / representatives commits and undertakes that they will take all measures necessary to prevent corruption. They commit to observe the following principles during their association / engagement with MHI or its agencies or its consultants engaged with the process of appraisal and verification of application for the approval of application under the Scheme. 2.1 The Applicant will not directly or through any other person or firm, offer, promise or give to any of the MHI's officer(s) or consultant or agency representative (appraisal or/ and verification agency appointed by MHI to handle the application) involved in the process of dealing with application or to any third person any material or other benefit which they are not legally entitled to in order to obtain in exchange any advantage of any kind whatsoever before or during or after the process of the application for grant of approval under the Scheme. 2.2 The Applicant will not commit any offence under the relevant IPC / PC Act; Further, the Applicant will not use improperly, for purposes of competition or personal gain, or pass on to others, any information or document provided by the MHI. 2.3 The Applicant shall disclose the name and address of the duly authorized Agents / Representatives who will be dealing with MHI or its agencies and the remuneration of these agents or representatives shall not include any hidden amount or component to get the work done in undue manner or causing inducement of whatsoever nature whether in cash or kind to influence the normal process or practice of work. 2.4 The Applicant will disclose any and all payments they have made, is committed to or intends to make to agents, brokers or any other intermediaries, other than regular employees or officials of the Applicant, in connection with the grant of approval. 2.5 The Applicant will not offer any illicit gratification to obtain unfair advantage. 2.6 The Applicant will not collude with other parties to impair transparency and fairness. 2.7 The Applicant will not give any advantage to anyone in exchange for unprofessional behaviour. 3. The Applicant declares that no pervious transgressions occurred in the last 3 years with any other Company in any country conforming to the anti-corruption approach or with any other Public Sector Enterprises / Central or State Government or its any instrumentality in India. 4. The Applicant agrees that if it is found that the Applicant has made any incorrect statement on this subject, the application will be closed or rejected and MHI reserve the right to initiate legal action of whatsoever nature. In case the Applicant has availed duty benefit under the Scheme, the duty forgone will be recoverable along with interest calculated at 3 years SBI Marginal cost of funds-based lending rate (MCLR) prevailing on the dates of availing benefits, compounded annually besides blacklisting of the Applicant and initiation of legal action of whatsoever nature at the discretion of MHI.
