Detailed Summary

The Ministry of Environment, Forest and Climate Change, in exercise of powers conferred by Section 62 of the Biological Diversity Act, 2002 (18 of 2003), and in consultation with the National Biodiversity Authority, hereby amends the Biological Diversity Rules, 2004, specifically inserting a new rule, Rule 11(w), concerning access and benefit sharing. This new rule empowers the National Biodiversity Authority to decide applications for access to biological resources and associated traditional knowledge for commercial utilization or research leading to commercial utilization. This decision-making power also includes determining the terms and conditions for such access, including the collection of fees, and ensuring equitable benefit sharing as per Section 21 of the Act. Furthermore, the notification clarifies that any previous general orders or guidelines issued by the NBA in this regard will cease to be effective from the date of this notification. This amendment streamlines the process for commercial access and benefit sharing under the Biological Diversity Act, 2002.
