This notification, G.S.R. 3(E) issued by the Ministry of Home Affairs on 29th December 2023 (published 2nd January 2024), makes the Ministry of Home Affairs, Indo-Tibetan Border Police Force, Deputy Commandant (Office) and Deputy Commandant (Principal Private Secretary), Group 'A' Posts, Recruitment Rules, 2023, in exercise of powers under clause (b) of sub-section (2) of section 156 of the Indo-Tibetan Border Police Force Act, 1992 (35 of 1992), and supersedes the 2011 Recruitment Rules for the same posts (except as respects things done before supersession); the rules take effect on publication and prescribe, per the Schedule, 13 posts (2023 sanction, subject to workload) of Deputy Commandant (Office) and 5 posts of Deputy Commandant (Principal Private Secretary), both General Central Service, Group 'A', Gazetted, Combatised Ministerial, Level-11 in the pay matrix (Rs. 67,700-208,700), filled solely by promotion from Assistant Commandant (Office), Level-10 (Rs. 56,100-177,500), with five years' regular service and completion of pre-promotional courses; the Departmental Promotion Committee comprises the Director-General or Additional Director-General ITBP (Chairman), the Inspector-General ITBP, the Deputy Inspector-General ITBP, and a Director or Deputy Secretary of the Ministry of Home Affairs (members); the rules also fix retirement at age sixty, bar appointment of persons involved in bigamous marriages (subject to Central Government exemption), require SHAPE-I medical fitness for promotion, empower the Central Government to relax provisions for any class of persons, and preserve reservation and other concessions for Scheduled Castes, Scheduled Tribes, other backward classes and ex-servicemen.

In exercise of the powers conferred by clause (b) of sub-section (2) of section 156 of the Indo-Tibetan Border Police Force Act, 1992 (35 of 1992) and in supersession of the Indo-Tibetan Border Police Force, Deputy Commandant (Office) and Deputy Commandant (Principal Private Secretary), Group 'A' Posts, Recruitment Rules, 2011, except as respects things done or omitted to be done before such supersession, the Central Government hereby makes the following rules regulating the method of recruitment to the posts of Deputy Commandant (Office) and Deputy Commandant (Principal Private Secretary) in the Indo-Tibetan Border Police Force, Ministry of Home Affairs, namely :- 1. Short title and commencement. (1) These rules may be called the Ministry of Home Affairs, Indo- Tibetan Border Police Force, Deputy Commandant (Office) and Deputy Commandant (Principal Private Secretary), Group 'A' Posts, Recruitment Rules, 2023. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Number of post, classification and level in the pay matrix.—The number of the said posts, their classifications and level in the pay matrix attached thereto, shall be as specified in columns (2) to (4) of the Schedule. 3. Method of recruitment, age-limit and other qualifications, etc..—The method of recruitment, age-limit, qualifications and other matters relating to the said posts, shall be as specified in columns (5) to (13) of the said Schedule. 4. Disqualification. —No person, — (a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to the said posts : Provided that the Central Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this rule. 5. Medical fitness. —Notwithstanding anything contained in these rules, those persons who are in medical category SHAPE-I, as specified in Health Care System in the Central Armed Police Forces, shall be eligible for promotion under the provisions of these rules. 6. Power to relax. - Where the Central Government is of the opinion that it is necessary or expedient so to do, it may, by order and for reasons to be recorded in writing relax any of the provisions of these rules with respect to any class or category of persons. 7. Superannuation. Officers holding the post of Deputy Commandant (Office) and Deputy Commandant (Principal Private Secretary) shall retire from service on the afternoon of the last day of the month in which they attain the age of sixty years: Provided that an officer whose date of birth is on the first day of a month shall retire from service on the afternoon of the last day of the preceding month on attaining the age of sixty years. 8. Saving. Nothing in these rules shall affect reservation, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, other backward classes, the Ex-servicemen and other special categories of persons in accordance with the orders issued by the Central Government from time to time in this regard.
