NOTIFICATION
Delhi, the 15th October, 2025
F. No. 85/Rules/DHC.—Whereas the High Court of Delhi, by way of amendments, proposes to amend the
existing Rules in two Orders in the First Schedule of the Code of Civil Procedure, 1908 (Central Act of 1908), which
would read as under :-
1. In Order VI
Rule 1 shall be substituted by the following :-
"1. Pleading. “Pleading” shall mean plaint or written statement or replication."
2. In Order VIII
1) Title of Order VIII shall be substituted by the following :-
"WRITTEN STATEMENT, SET-OFF, COUNTER-CLAIM AND REPLICATION”
2) Rule 9 shall be substituted by the following :-
"9. Subsequent pleadings, replication.— (1) The Court may at any time require a written statement
or additional written statement from any of the parties and fix a time of not more than thirty days for
presenting the same.
(2) The replication, if any, shall be filed within thirty days of receipt of the written statement:
Provided that where the plaintiff fails to file the replication within the said period of thirty days, he
shall be allowed to file the same on such other day, as may be specified by the Court, for reasons to be
recorded in writing, but which shall not be later than forty five days from the receipt of the written
statement. For such extension, the plaintiff may be burdened with costs, as deemed appropriate.
(3) Where the plaintiff relies upon any document in his possession or power, in support of the
replication, he shall enter such document in a list, and shall produce it in Court when the replication is
presented and shall, at the same time, deliver the document and a copy thereof, to be filed with the
replication."
AND whereas the objections, in writing, from any person, with respect to said amendments are invited within
a period of one month i.e. 30 days from the date of which this Notification is published in Part-II, Section-I of Delhi
Gazette Extraordinary.
