The National Biodiversity Authority (NBA) has issued this notification to amend the previous notification S.O. 689(E) dated 4th April, 2011, specifying 'Digital Sequence Information' as a biological resource for access and benefit-sharing under the Biological Diversity Act, 2002.

Detailed Summary

This notification, issued by the National Biodiversity Authority (NBA) on 26th March, 2024, in exercise of powers conferred by Section 63 of the Biological Diversity Act, 2002 (18 of 2003), and in supersession of previous notification S.O. 689(E) dated 4th April, 2011, specifies 'Digital Sequence Information' (DSI) as a 'biological resource' under clause (c) of Section 2 of the Biological Diversity Act, 2002. This means that access to DSI, its transfer, and the sharing of its benefits will now be governed by the provisions of the Biological Diversity Act, 2002, and the Biological Diversity Rules, 2004, including Rule 11(w) of the Biological Diversity Rules, 2004. This amendment clarifies that DSI derived from biological resources is to be treated as a biological resource itself for the purpose of the Act and its regulations.
