By notification F. No. 1/31/1138/LC/Estt./Rectt.Rules/Lab.Asstt.Sr./2023/6760 dated 10 January 2024, the Lt. Governor of the National Capital Territory of Delhi, exercising powers under the proviso to Article 309 of the Constitution read with Ministry of Home Affairs notification No. F.27/59-Him(i) dated 13 July 1959, and in supersession of the Delhi Government's earlier notification No. 10(83)/87-Labour/Estt./1745-49 dated 8 February 1988 (save as respects things done before supersession), makes the 'Laboratory Assistant (Senior) and Laboratory Assistant (Junior) Recruitment Rules, 2023' for the Labour Department, Government of NCT of Delhi, effective from the date of publication in the Delhi Gazette. The rules prescribe the number of posts, classification and pay scale (Schedule-I) and the method of recruitment, age limit and qualifications (Schedule-II). For the post of Laboratory Assistant (Senior): one post (2023, subject to variation based on workload); General Central Service, Non-Gazetted, Non-Ministerial, Group 'C', Pay Level-5 (Rs. 29,200-92,300); recruitment is by Deputation/Promotion from officers holding an analogous post or with five years' service in Level-4 of the pay matrix, possessing an M.Sc. in Chemistry/Bio-Chemistry or a B.Sc. with Chemistry/Bio-Chemistry and two years' experience in a government or recognised laboratory; deputation period ordinarily not to exceed three years, with a maximum age of 56 years for deputation (ISTC); UPSC consultation is not required. The rules include standard disqualification provisions barring persons who have contracted a bigamous marriage (subject to Government exemption where personal law permits), a power to relax provisions for any class of persons, and a saving clause preserving reservations and concessions for Scheduled Castes, Scheduled Tribes, Other Backward Classes, Ex-servicemen and other special categories.

No. 1/31/1138/LC/Estt./Rectt.Rules/Lab.Asstt.Sr./2023/6760.—In exercise of the powers conferred by the proviso to article 309 of theConstitution read with Government of India, Ministry of Home Affairs, Notification No. F.27/59-Him (i) dated 13th July, 1959 and all other powers enabling him in this behalf and in supersession of this Government's Notification No. 10(83)/87-Labour/Estt./1745-49 dated 08.02.1988 except as respects things done or omitted to be done before suchsupersession, the Lt. Governor of the National Capital Territory of Delhi is pleased to make the following rules regulating the method of recruitment to the post of Laboratory Assistant (Senior) and Laboratory Assistant (Junior) in the Labour Department, Government of National Capital Territory of Delhi, namely: 1. Short title and commencement: i) These rules may be called “Laboratory Assistant (Senior) and Laboratory Assistant (Junior)" Recruitment Rules, 2023. ii) They shall come into force on the date of their publication in the Delhi Gazette. 2. Number of Posts, Classification and Scale of Pay: The number of the said posts, their classification and the scale of pay attached thereto shall be as specified in column (2) to (4) of the Schedule annexed to these rules. 3. Method of recruitment, age-limit, qualifications etc.: The method of recruitment to the said posts, age-limit, qualifications and other matters connected therewith, shall be as specified in column (5) to (13) of the said schedule. 4. Disqualifications: No person, a) Who has entered into or contracted a marriage with a person having a spouse living, or b) Who having a spouse living, has entered into or contracted a marriage with a person, Shall be eligible for appointment to the said post: Provided that the Government may, if satisfied, that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for so doing exempt any person from the operation of this rule. 5. Power to relax: Where the Government is of the opinion that it is necessary expedient so to do, it may by order, and for reasons to be recorded in writing, relax anyof the provisions of this rule with respect of any class or category of persons. 6. Saving: Nothing in these rules shall affect reservations, relaxation of age limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, Other Backward Classes, Ex-servicemen or any other special category of persons in accordance with the orders issued by the Government from time to time in this regard.
