to amend Delhi Shops and Establishments Act, 1954 in its application to the National Capital Territory
of Delhi.
BE it enacted by the Legislative Assembly of National Capital Territory of Delhi in the Seventy-sixth Year
of the Republic of India as follows:-
1. (1) This Act may be called the Delhi Shops and Establishments (Amendment) Bill, 2026.
(2) It shall come into force on such date as the Government of National Capital Territory of Delhi
may, by notification in the Official Gazette, appoint;
2. Amendment to the Delhi Shops and Establishments Act, 1954: The Delhi Shops and
Establishments Act, 1954 (Act No. 7 of 1954) (hereinafter referred to as the Principal Act) is hereby
amended to the extent and in the manner mentioned below in its application to the National Capital
Territory of Delhi.
3. Amendment of Section 1:
In Section 1 of the Principal Act, after sub-section (4), the following sub-section shall be inserted,
namely:-
"(5) The Act shall be applicable to Shops and Establishments employing twenty or more employees."
4. Amendment of Section 2:
In Section 2 of the Principal Act, in sub-section (2), for the words "twelth year" shall be substituted by
words "fourteenth year".
5. Amendment of Section 8:
(1) In Section 8 of the Principal Act, for the words "nine hours" shall be substituted by the words "ten
hours inclusive of rest interval and lunch break".
(2) In Section 8 of the Principal Act, in the first proviso, for the words "but not exceeding 54 hours in
any week subject to the conditions that the aggregate hours so worked shall not exceed 150 hours in a year"
shall be substituted by "but not exceeding sixty hours in any week subject to the conditions that the
aggregate hours so worked shall not exceed one hundred forty four hours in a quarter".
6. Amendment of Section 10:
In Section 10 of the Principal Act, for the words "five hours" shall be substituted by the words "six
hours".
7. Amendment of Section 11: In Section 11 of the Principal Act, for the words "ten and a half hours in
any commercial establishment or for more than twelve hours in any shop" shall be substituted by the words
"twelve hours".
8. Substitution of Section 14:
For Section 14 of the Principal Act, the following section shall be substituted namely:-
"(1) No young person shall be required or permitted to work whether as an employee or otherwise
in any establishment during night.
(2) Women shall be entitled to be employed in all establishments to work and they may also be
employed, with their consent between 9.00 PM to 7.00 AM during the summer season and between 8:00
PM to 8:00 AM during the winter season subject to the conditions at sub-clause (i) to (vi):-
(i) Written consent of women employees shall be required before employing them in night shifts.
(ii) The employer will provide adequate CCTV Surveillance, Security and proper Transport facility
to the women employees including employees of contractors during the night shifts.
(iii) No employer of any shop or establishment shall knowingly employ a woman in any
establishment during six weeks following the day of her confinement or miscarriage.
(iv) a minimum of two women employees shall be employed during the period mentioned in
sub-section(2).
(v) The employer of such shops and establishment shall be required to abide by the provisions of
Prevention of Sexual Harassment of Women at Work Place (Prevention, Prohibition and
Redressal) Act, 2013 as amended from time to time.
(vi) Such other conditions as may be notified in this regard by the Government of National Capital
Territory of Delhi from time to time."

STATEMENT OF OBJECTS AND REASONS
The Delhi Shops and Establishments Act, 1954 regulates the working conditions of employees in shops,
commercial establishments, residential hotels, restaurants, theatres and other establishments within the
National Capital Territory of Delhi. The Government of India, through DPIIT, has advised labour reforms
related to working hours, employment thresholds, overtime regulation, and facilitating women's employment
under Delhi Shops and Establishments Act, 1954.
The proposed amendments seek to increase flexibility in working hours, revise overtime limits, permit
employment of women during night hours with their consent and adequate safeguards, and raise the
applicability threshold of the Act, with a view to promoting employment generation, economic activity and
gender inclusion, while maintaining worker protection.
The Bill seeks to achieve the aforesaid objectives.

MEMORANDUM OF DELEGATED LEGISLATION
Section 8 of the bill empowers the Government of National Capital Territory of Delhi to notify the conditions
for creating safe working environment for women.
