Furthermore, Clause (iv)(d) and Clause (iv)(f) of Regulation 24(4), both pertaining to the recovery of interest on working capital or delayed payments based on the State Bank of India's one-year Marginal Cost of Funds Based on Lending Rate (MCLR) plus 350 basis points, are hereby deleted. An 'Explanation' is inserted under Clause (iv)(e) of Regulation 24(4), clarifying that if works are not completed by the Discom (Licensee), they are liable to refund the advance forthwith, and if they fail, recovery will be made through Delhi Transco Ltd. as the Nodal Agency, which will raise a recovery claim to the Discom, and the payment received by Delhi Transco Ltd. shall be remitted to the concerned department. No. 171 PART III GOVERNMENT OF THE NATIONAL CAPITAL TERRITORY OF DELHI DELHI ELECTRICITY REGULATORY COMMISSION CORRIGENDUM Delhi, the 7th August, 2025 F.No. 17(220)/DERC/Engg./2023-24/7898/751.—Whereas Delhi Electricity Regulatory Commission (Supply Code and Performance Standards) (Seventh Amendment) Regulations, 2025, have been notified by DERC vide Notification dated 02.06.2025. However, it has been considered necessary to issue the following corrigendum in the said Amendment. 1. The Clause (iv)(c) para (2) of Regulation 24(4) of the Seventh Amendment Regulations, may be read as under: "The balance 70% along with taxes as applicable shall be paid upon completion of each stage/milestone based on submission of documents namely Invoice, and completion report by the Licensee, as applicable. The Concerned Department of Govt. of NCT of Delhi shall release the payment to the Discom (Licensee) promptly and maximum within the period of 45 days" 2. The Clause (iv)(d) of Regulation 24(4) of the Seventh Amendment Regulations, which reads as under, is hereby deleted: “In order to cover the working capital required by the Discom (Licensee) till the release of the balance 70% payments along with taxes, the interest on the said amount, equivalent to the marginal cost of funds based on lending rate (MCLR) for one year of the State Bank of India, as applicable on the 1st April of the financial year, plus 350 basis points, during the period of execution of work, shall form the part of the estimated cost." 3. For the purpose of removing any ambiguity in the application of the amended Regulation, an “Explanation" is hereby inserted under Clause (iv)(e) of Regulation 24(4) of following Seventh Amendment Regulations: - "Explanation: In case the works are not completed by the Discom (Licensee), latter shall be liable to refund the advance forthwith. In case the Discoms fail to refund the amount of the advance paid by the Government Department, the recovery of the same shall be made through Delhi Transco Ltd. as the Nodal Agency, which will raise the bill (recovery claim) to the Discom (Licensee), and the payment against which shall be released by the Discom (Licensee) like other bills raised by the Delhi Transco Ltd. The payment so, received by the Delhi Transco Ltd. from Discom (Licensee) shall be forthwith remitted to the concerned department." 4. The Clause (iv)(f) of Regulation 24(4) of the Seventh Amendment Regulations, which reads as under, is hereby deleted: "In case of delay in payment of the balance 70% amount beyond 45 days of submission of final invoice and other documents, interest on the said amount, equivalent to the marginal cost of funds based on lending rate (MCLR) for one year of the State Bank of India, as applicable on the 1st April of the financial year, plus 350 basis points, shall be recoverable by the Discom (Licensee) from the concerned Department of Govt. of NCT of Delhi." 5. All other provisions of the "(Supply Code and Performance Standards) (Seventh Amendment) Regulations, 2025" shall remain unchanged. This Corrigendum is issued with the approval of the Commission.
