Core Purpose

The High Court of Delhi hereby amends Chapter 1 of Volume V of the Delhi High Court Rules & Orders to establish a new procedure for the constitution and management of a Panel of Commissioners.

Detailed Summary

The High Court of Delhi, exercising powers conferred by Section 7 of the Delhi High Court Act, 1966 (Act 26 of 1966), issued Notification No. 66/Rules/DHC on September 2, 2025, to amend Chapter 1 of Volume V of the Delhi High Court Rules & Orders. This amendment inserts a new Part G after existing Part F, detailing the "Constitution of Panel of Commissioners." Key provisions include: the Chief Justice shall constitute a Committee for empanelment, which will determine application procedures and eligibility criteria, potentially creating separate panels for different commission types like recording evidence or preparing inventory of goods. The Registrar General, as directed by the Committee, will invite applications, with notices uploaded on the official websites of the Delhi High Court, all District Courts, and relevant Bar Associations. The Committee may also invite applications from professionals in fields such as accounting, architecture, engineering, information technology, medicine, and valuation. Recommendations for empanelment, additions, or deletions from the panel require the Chief Justice's approval. The Commissioners Panel will remain effective for two calendar years from its issue date, with a list circulated to all Delhi High Court benches specifying professional experience and expertise. While courts may consider the panel for appointments, the ultimate appointment remains a judicial function. Complaints against panel members will be dealt with by the Committee, which will make recommendations to the Chief Justice, who also retains the power to remove any Commissioner from the panel. This amendment comes into force from the date of its publication in the Gazette.
