Final Order in connection with the Hearing held before the Jute Commissioner on 30.09.2024 at 4 PM for M/s Averill Infrastructure Pvt. Ltd.

The hearing on above mentioned date was heard at length. All the submission was recorded including counter arguments. The department was asked to place the file before me for taking appropriate decision in the matter. Taking into account the antecedents of the alleged mill, the offence committed in this present case, the reply received by the alleged mill in the present case and upon hearing of all sides on the given date as well as the document in the record being perused it is manifested that the offence committed is established. Hence it is ORDERED 1. The 96 bales seized by the Department lying at CONCOR terminal (Shalimar) should be segregated and only the bales with broken / tampered seals are to be replaced by the mill at their own risk and cost within 7 days from the date of issue of this order. The rest of the seized bales (i.e. which are without seal tampering or without broken seal) lying in the possession of CONCOR at the Shalimar Terminal are hereby released for dispatch. 2. The 144 bales seized by the Department lying inside the mills premises should be replaced by the mill at its own risk and cost, and thereafter it should be inspected by the designated inspection agency before dispatch under intimation to this Department. 3. M/s Averill Infrastructure Pvt. Ltd. will get PCSO by deducting 25% of the scheduled capacity for 3 (three) consecutive months starting from January 2025. 4. A compliance report (on directives at Sl. No. 1 and 2 as above) should be submitted by the aforesaid jute mill company before this authority through this Department, within 15 days from the date of issue of this Order, failing which the Department should appear before this authority praying for further punitive measures as per statute and / or financial recovery or both. However, the mill company will be of liberty to file an appeal before the competent authority as embodied in Jute & Jute Textiles Control Order, 2016 within the prescribe period of limitation i.e. 30 days.
