ORDER
Kolkata, the 18th December, 2024
S.O. 5655(E).— This is pursuant to the hearing held on 21.10.2024 and subsequently Record of Proceedings
forwarded vide this office letter dated 14.11.2024.
Vide aforementioned Record of Proceedings, the jute mill coy. was given liberty to file any written argument
clarifying the technical issues involved in the complaint before this adjudicating authority. Subsequently, the mill coy.
vide letter under Ref. No. Nil dated 21.11.2024 has submitted their written arguments, which are as follows
“1. The Joint Inspection (JI) was carried out on 04.09.2024. The subject bales which were originally inspected on
21.04.2024, and after a gap of nearly 5 months of dry season, how can bags regain moisture from 8%
(on 21.04.2024) to 8.21% (on 04.09.2024).
2. We have pointed out the potential fault of moisture meter used in the JI which cannot record moisture content
below 8% (73% of bags found with 8% MR during JI).
3. Original Complaint No. PBPGK170424HMS31033/COMP01, dated 22.07.2024 which state, "Bag is not as per
I.S. specifications. Bag's length, width, ends, picks, weight, stitch, bag defective, major and minor defects, etc., are
not as per
specification."However, no such defects were reported in the Joint Inspection (J.I) report
dated04.09.2024 except corrected mass of the bag which was not properly accounted for due to range restrictions of
moisture meter used during JI.
In light of the above, we would request you to re-consider the matter in proper perspective and exonerate us from
the allegations as we did not indulge into any unfair practice."
The aforesaid submission of mill coy. has been kept on record. The department was asked to place the file
before me for taking appropriate decision in the matter. The issue of moisture is a scientific observation which has
been made in the Joint Inspection, where the mill representative was also present.
It is therefore directed that 48 rejected bales have to be replaced by the mill at their own risk and cost within
30 days from the date of issue of this order and submit a compliance report to the department forthwith including
documentary proof of acceptance of the goods by the consignee, failing which necessary recovery of equivalent cost
of rejected bales from the pending bills for payment pertaining to the mill coy. shall be initiated by the department.
Let this Order be circulated to all the parties' forthwith.
