NOTIFICATION
New Delhi, the 20th July, 2026
G.S.R. 669 (E). — In exercise of the powers conferred by clause (xa) of sub-section (2) of section
49 of the Tea Act, 1953 (29 of 1953), the Central Government hereby makes the following rules to amend
the Tea (Holding Inquiry and Appeal) Rules, 2024, namely: —
1. Short title and commencement. -(1) These rules may be called the Tea (Holding Inquiry and Appeal)
Amendment Rules, 2026.
(2) They shall come into force on the date of their publication in the Official Gazette.
2. In the Tea (Holding Inquiry and Appeal) Rules, 2024 (hereinafter referred to as the said rules), in
rule 3-
(i) in sub-rule (1), for the words "purpose of adjudication", the words "purposes of issuing a warning letter
or adjudication" shall be substituted;
(ii) after sub-rule (8), the following sub-rule shall be inserted, namely: -
"(8A) Notwithstanding anything contained in sub-rule 8, if the person has committed a contravention of
provisions under section37 of the Act, the adjudicating officer shall issue a warning letter at the first instance,
and in case of subsequent contravention, he may impose a penalty which may extend to one lakh rupees.";
(iii) for sub-rule (9), the following sub-rule shall be substituted, namely:-
“(9) Every order made under sub-rules (8) or (8A), as the case may be, shall specify the provision of the Act
in respect of which contravention has been committed and shall contain the reasons for issuing the warning
letter or imposing the penalty.".
3. In the said rules, in Form-I, in paragraph 2, for the words "imposition of penalty", the words "issuing a
warning letter or imposition of penalty" shall be substituted.
