The Ministry of Mines, through G.S.R. 683(E) dated 30th July, 2026, exercised powers under section 18 of the Mines and Minerals (Development and Regulation) Act, 1957 (67 of 1957) to enact the Mineral Conservation and Development (Second Amendment) Rules, 2026. These rules, effective from 1st August, 2026, further amend the Mineral Conservation and Development Rules, 2017, which were originally published vide G.S.R. 169 (E) dated 27th February, 2017, and subsequently amended seven times. Key amendments include inserting 'or insurance surety bond' after 'bank guarantee' in rule 27(2) and 27(6); omitting sub-rule (4B) from rule 35 and its reference in rule 35(5) proviso; substituting rule 45(7)(a)(ii) and rule 45(7A)(ii)(a) and (iii) to specify penalty adjudication in accordance with the Mines and Minerals Adjudication of Penalties Rules, 2026; substituting rule 62 to stipulate penalties for contravention as per sections 25A and 25B of the parent Act and the Mines and Minerals Adjudication of Penalties Rules, 2026; and omitting SCHEDULE – II and SCHEDULE – III from the principal rules.

L.-33004/99 The Gazette of India CG-DL-E-31072026-275001 EXTRAORDINARY PART II—Section 3—Sub-section (i) PUBLISHED BY AUTHORITY No. 621] NEW DELHI, THURSDAY, JULY 30, 2026/SHRAVAN 8, 1948 MINISTRY OF MINES NOTIFICATION New Delhi, the 30th July, 2026 G.S.R. 683(E). — In exercise of the powers conferred by section 18 of the Mines and Minerals (Development and Regulation) Act, 1957 (67 of 1957), the Central Government hereby makes the following rules further to amend the Mineral Conservation and Development Rules, 2017, namely:— 1. Short title and commencement: Amendment) Rules, 2026. (1) These rules may be called the Mineral Conservation and Development (Second (2) They shall come into force on the 1st day of August, 2026. 2. 3. 4. 5. 6. In the Mineral Conservation and Development Rules, 2017 (hereinafter referred to as the said rules), in rule 27, — (a) in sub-rule (2), after the words "bank guarantee", the words "or insurance surety bond" shall be inserted; (b) in sub-rule (6), after the words "bank guarantee", the words “or insurance surety bond" shall be inserted. In the said rules, in rule 35, — (a) sub-rule (4B) shall be omitted; (b) in sub-rule (5), in the proviso, the brackets, figure and letter "(4B)” shall be omitted. In the said rules, in rule 45, — (a) in sub-rule (7), in clause (a), for sub-clause (ii), the following sub-clause shall be substituted, namely: – "(ii) take action to initiate adjudication of penalty for contravention of rules in accordance with the Mines and Minerals Adjudication of Penalties Rules, 2026;"; (b) in sub-rule (7A), – (i) in clause (ii), in sub-clause (a), for the words “such amount as specified in Schedule II", the words "penalty in accordance with the Mines and Minerals Adjudication of Penalties Rules, 2026 “shall be substituted; (ii) in clause (iii), for the words "such amount as specified in Schedule II", the words "penalty in accordance with the Mines and Minerals Adjudication of Penalties Rules, 2026" shall be substituted; In the said rules, for rule 62, the following rule shall be substituted, namely: – "62. Penalty. - Whoever contravenes the provisions of these rules shall be liable to penalty in accordance with the provisions of section 25A and 25B and the rules made thereunder (i.e., the Mines and Minerals Adjudication of Penalties Rules, 2026).".
