                Detailed Summary
            

            
The Ministry of Environment, Forest and Climate Change has issued a notification, S.O. 1395(E), dated 14th March, 2024, in exercise of powers conferred by Section 54 of the Biological Diversity Act, 2002 (18 of 2003). This notification details the regulations for access to biological resources and associated traditional knowledge from India by Indian citizens, companies, associations, or organizations for commercial utilization or bio-survey and bio-utilization. It specifies that such access requires prior intimation to the concerned State Biodiversity Board. The notification outlines that if the access is for commercial utilization, the applicant must obtain prior approval from the National Biodiversity Authority. It further clarifies that these regulations are in addition to and not in derogation of any other laws in force and come into effect from the date of their publication in the Official Gazette.
