Detailed Summary

The Ministry of Labour and Employment, by S.O. 3817(E) dated 28 August 2023, in exercise of powers under the proviso to sub-clause (vi) of clause (n) of section 2 of the Industrial Disputes Act, 1947 (14 of 1947), declared the services engaged in the manufacture or production of mineral oil (crude oil), motor and aviation spirit, diesel oil, kerosene oil, fuel oil, diverse hydrocarbon oils and their blends including synthetic fuels, and lubricating oils and the like -- covered under item 26 of the First Schedule to the said Act -- to be a public utility service for a further period of six months with effect from 28 August 2023. The industry had previously been declared a public utility service for six months with effect from 28 February 2023 vide notification S.O. 1265(E) dated 17 March 2023, and the Central Government determined that public interest required extending that status. The notification was signed by Deepika Kachhal, Joint Secretary, under file number S-11017/2/2018-IR(PL).

L. -33004/99 EXTRAORDINARY PART II —Section 3 —Sub-section ( ii) PUBLISHED BY AUTHORITY No. 3656 ] NEW DELHI, MON DAY, AUGUST 28, 2023/BHADRA 6, 194 5 CG-DL-E-28082023-248382 MINISTRY OF LABOUR A ND EMPLOYMENT NOTIFICATION New Delhi, the 28th August, 2023 S.O. 3817(E).—Whereas the Central Government is satisfied that public interest so requires that the services engaged in manufacture or production of mineral oil (crude oil), motor and aviation spirit, diesel oil, kerosene oil, fuel oil, diverse hydrocarbon oils and their blends including synthetic fuels , lubricating oils and the like, which is covered under items 26 of the First Schedule to the Industrial Disputes Act, 1947 (14 of 1947), to be public utility service for the purposes of the said Act; And whereas the Central Government has lastly declared the said industry to be public utility service for the purposes of the said Act for a period of six months with effect from the 28th February, 2023, vide notification of the Government of India in the Ministry of Labour and Employment, number S.O. 1265(E) , dated the 17th March, 2023; And whereas the Central Government is of the opinion that public interest requires the extension of the public utility service status to the said industry for a further period of six months; Now, therefore, in exercise of the powers conferred by the proviso to sub -clause (vi) of clause (n) of section 2 of the Industrial Disputes Act, 1947 (14 of 1947), the Central Government hereby declares the services of the industry engaged in the manufacture or production of mineral oil (crude oil), motor and aviation spirit, diesel oil, kerosene oil, fuel oil, diverse hydrocarbon oils and their blends including synthetic fuels, lubricating oils and the like to be a public utility service for the purposes of the said Act for a period of six months with effect from 28th August, 2023 .
