The Ministry of Labour and Employment, by notification S.O. 5463(E) dated 27th December 2023, extends under the proviso to sub-clause (vi) of clause (n) of Section 2 of the Industrial Disputes Act, 1947 (14 of 1947) the declaration that services engaged in the Coal industry, covered under item 4 of the First Schedule to the said Act, constitute a public utility service, noting that the Central Government had previously declared this status for six months from 28th June 2023 via notification S.O. 2431(E) dated 5th June 2023, and now extends the public utility service status for a further period of six months with effect from 28th December 2023, on grounds of public interest.

7956 GI/202 3 (1) EXTRAORDINARY PART II —Section 3 —Sub-section ( ii) PUBLISHED BY AUTHORITY No. 5232] NEW DELHI , WEDNES DAY , DECEMBER 27, 2023/ PAUS HA 6, 1945 CG-DL-E-27122023-250923 MINISTRY OF LABOUR AND EMPLOYMENT NOTIFICATION New Delhi, the 27 th December, 2023 S.O. 5463(E). —Whereas the Central Government is satisfied that public interest so requires that the services engaged in the Coal industry, which is covered under item 4 of the First Schedule to the Industrial Disputes Act, 1947 (14 of 1947), to be a public utility servic e for the purposes of the said Act; And whereas the Central Government had declared the said industry to be public utility service for the purposes of the said Act for a period of six months from the 28th June, 2023 vide notification of the Government of India in the Ministry of Labour and Employment number S.O. 2431 (E), dated the 5th June, 2023; And whereas the Central Government is of the opinion that public interest requires the extension of the public utility service status to the said industry for a further period of six months; Now, therefore, in exercise of the powers conferred by the proviso to sub -clause (vi) of clause (n) of section 2 of the Industrial Disputes Act, 1947 (14 of 1947), the Central Government her eby declares the services engaged in the Coal industry to be public utility service for the purposes of the said Act for a period of six mon ths with effect from the 28th December, 2023.
