The Ministry of Commerce and Industry (Department of Commerce), through two notifications, S.O. 5895(E) and S.O. 5896(E), both dated 19th December, 2025, has relaxed provisions of the Tobacco Board Act, 1975 (Act 4 of 1975), and authorized the Tobacco Board regarding the sale and purchase of Flue Cured Virginia Tobacco (FCV Tobacco) in the State of Karnataka for the crop season 2025-2026. Notification S.O. 5895(E), issued under sub-section (1) of section 30, relaxes the operation of sub-section (1) of section 10 read with sub-section (1) of section 14A of the said Act, permitting the sale of excess FCV Tobacco from registered growers and unauthorized FCV Tobacco from unregistered growers at authorized auction platforms. Notification S.O. 5896(E), issued under section 20A, authorizes the Tobacco Board to allow registered traders and dealers to purchase this tobacco at auction platforms in Karnataka, subject to specific conditions for contributions to the Tobacco Fund. These conditions include a normal service charge of one percent of sale proceeds for registered growers for excess FCV Tobacco up to ten percent of their authorized quota. For excess FCV Tobacco between ten and twenty percent, registered growers must contribute rupee one per kilogram and two percent of sale proceeds (excluding the one percent normal service charge). For excess FCV Tobacco exceeding twenty percent, registered growers must contribute rupee one per kilogram and three percent of sale proceeds (excluding the one percent normal service charge). Unregistered growers must contribute rupee one per kilogram and five percent of sale proceeds (excluding the one percent normal service charge) for their FCV Tobacco.

[F.No. 5/3/2019-EP(Agri-VI)/Pt.] YASHVIR SINGH, Economic Adviser 3 NOTIFICATION New Delhi, the 19th December, 2025 S.O. 5896(E).— In exercise of the powers conferred by section 20A of the Tobacco Board Act, 1975 (Act 4 of 1975), the Central Government hereby authorises the Tobacco Board to allow the registered traders and dealers of the Tobacco Board to purchase at their auction platforms in the State of Karnataka for the auctions during crop season 2025-2026, the excess Flue Cured Virginia Tobacco (hereinafter referred to as FCV Tobacco) produced by registered growers and unauthorised FCV Tobacco produced by unregistered growers in the State of Karnataka, subject to the following conditions, namely:- (a) a normal service charge of one per cent. of proceeds of sale payable by growers shall be contributed to the Tobacco Fund by every registered grower for the excess FCV Tobacco produced upto the extent of ten per cent. of the quota authorised for 2025-26 crop season; (b) an amount of rupee one per kilogram and two per cent. of the proceeds of sale (excluding normal service charge of one per cent. of proceeds payable by growers) shall be contributed to the Tobacco Fund by every registered grower for the excess FCV Tobacco produced over and above the limit of ten per cent. and upto twenty per cent. of the quota authorised for 2025-26 crop season; (c) an amount of rupee one per kilogram and three per cent. of the proceeds of sale (excluding normal service charge of one per cent. of proceeds payable by growers) shall be contributed to the Tobacco Fund by every registered grower for the excess FCV Tobacco produced over and above the limit of twenty per cent. of the quota authorised for 2025-26 crop season; (d) an amount of rupee one per kilogram and five per cent. of the proceeds of sale (excluding normal service charge of one per cent. of proceeds payable by growers) shall be contributed to the Tobacco Fund by every unregistered grower for the FCV Tobacco produced for 2025-26 crop season.
