Issued by the Ministry of Finance, Department of Revenue via Notification No. 18/2024-Customs (ADD), G.S.R. 651(E) dated 21st October 2024, in exercise of powers under sub-sections (1) and (5) of section 9A of the Customs Tariff Act, 1975 (51 of 1975) read with rules 18 and 20 of the Customs Tariff (Identification, Assessment and Collection of Anti-dumping Duty on Dumped Articles and for Determination of Injury) Rules, 1995. Based on the designated authority's final findings (F. No. 06/12/2023-DGTR dated 23rd July 2024) that the dumping margin for 'Unframed Glass Mirror' (tariff item 7009 91 00) from the People's Republic of China is positive and significant, that the domestic industry suffered material injury, and that the injury was caused by the dumped imports, the Central Government imposes anti-dumping duty of USD 234 per MT on Unframed Glass Mirror originating in China PR (any country of export) and on such goods exported from China PR (any country of origin), for any producer. Framed glass mirrors, decorative glass mirrors, and silver-coated mirror glass are excluded from the product scope. The duty is levied for five years from the date of publication unless revoked, superseded, or amended earlier, payable in Indian currency. Issued under F. L.-33004/99 The Gazette of India CG-DL-E-21102024-258114 EXTRAORDINARY PART II-Section 3-Sub-section (i) PUBLISHED BY AUTHORITY No. 595] NEW DELHI, MONDAY, OCTOBER 21, 2024/ASVINA 29, 1946 MINISTRY OF FINANCE (Department of Revenue) NOTIFICATION New Delhi, the 21st October, 2024 No. 18/2024-Customs (ADD) G.S.R. 651(E).—Whereas in the matter of "Unframed Glass Mirror" (hereinafter referred to as the 'subject goods') falling under tariff item 7009 91 00 of the First Schedule to the Customs Tariff Act, 1975 (51 of 1975) (hereinafter referred to as the Customs Tariff Act), originating in, or exported from People's Republic of China (hereinafter referred to as the ‘subject country'), and imported into India, the designated authority in its final findings vide notification F. No.06/12/2023-DGTR dated the 23rd July 2024, published in the Gazette of India, Extraordinary, Part I, Section 1, has come to the conclusion that the,- (i) dumping margin for the subject goods from the subject country is positive and significant; (ii) domestic industry has suffered material injury; (iii) material injury to the domestic industry has been caused by the dumped imports from the subject country, and has recommended imposition of an anti-dumping duty on the imports of subject goods, originating in, or exported from the subject country and imported into India, in order to remove injury to the domestic industry. The anti-dumping duty imposed under this notification shall be levied for a period of five years (unless revoked, superseded or amended earlier) from the date of publication of this notification in the Official Gazette and shall be payable in Indian currency. Explanation. - For the purposes of this notification, rate of exchange applicable for the purposes of calculation of such anti-dumping duty shall be the rate which is specified in the notification of the Government of India, Ministry of Finance (Department of Revenue), issued from time to time, in exercise of the powers conferred by section 14 of the Customs Act, 1962 (52 of 1962), and the relevant date for the determination of the rate of exchange shall be the date of presentation of the bill of entry under section 46 of the said Act.
