NOTIFICATION
New Delhi, the 14th November , 2023
G.S.R. 835(E).—The draft of the following rules to amend the Calcium Carbide Rules, 1987, which Central
Government propos es to make in exercise of the powers conferred by sub -section (2) of Section 29 of the Petroleum
Act, 1934 (30 of 1934) is hereby published as requ ired by sub -section (3) of Section 29 of the said Act for information
of all persons likely to be affected thereby, and notice is hereby given that the said draft shall be taken into
consideration after the expiry of a period of forty -five days from the da te on which the copies of the Gazette of India
containing this notification are made available to public.
Objections or suggestions if any, to these draft rules may be sent to the Director, Department for Promotion
of Industry and Internal Trade, Ministry of Commerce and Industry, Room No. 254 A, Udyog Bhavan, New Delhi –
110 011 or Email: [email protected]; [email protected], within the period specified above;
The objections or suggestions which may be received from any person with respect to the said draft rules
within the period above so specified will be taken into consideration by the Central Government.
Draft Rules
1. (1) These rules may be called the Calcium Carbide (Amendment) Rules, 2023
(2) They shall come into force on the date of their final pu blication in the Official Gazette.
2. In the said rules, in Rule 4, the words and figures ―Provided that nothing in this rule shall apply to the
delivery or dispatch to any person of Carbide in quantities which are permitted by Rule 26 to be stored
without a licence.‖ shall be substituted with: -
―Provided that nothing in this rule shall apply to the delivery or dispatch of Carbide permitted by Rule 26.‖
3. In the said rules, in Rule 25, the words ―with or‖ shall be deleted.
4. In the said rules, Rule 26, shall be su bstituted namely: -
―26 Licence for storage –(1) No person shall store any carbide except under a licence granted under these
Rules :
Provided that no licence shall be required for storage of carbide –
(a) temporarily within port limits under such conditio ns as the Conservator of the port may specify,
(b) while in transit under the custody of railway administration or road transport agency;
(c) in the possession of the Defence Forces of the Union;
5. In the said rules in Rule 27 after sub rule (4) following shall be inserted namely: -
―(5)(a) Carbide in any quantity not exceeding five kilograms shall be stored in prescribed receptacles each
containing not more than one kilogram;
(b) in any quantity exceeding five kilograms but not exceeding two hundred kilogra ms shall be stored: -
(i) in receptacles stored in a dry and well ventilated storage shed, which may form a part of or attached to a
building provided that it is separated there from by a substantial partition and the only means of access to it is
from outs ide air;
(ii) due precautions shall be taken to prevent unauthorized persons from having access to the receptacles;
(iii) the receptacles shall be kept securely closed except while taking out carbide there from.‖
