This exemption is from the applicability of Government of India Notification S.O. 2063 dated 21st June, 1988, which was published in the Gazette of India, Part II, section 3, sub-section (ii), concerning the employment of contract labour for works specified against serial numbers 1 to 3 in its Schedule. The exemption is granted for a period of three years from the date of publication of this notification and is subject to several conditions. These conditions include protecting the interest of the workmen engaged in the mentioned works, ensuring they are paid wages and other benefits as per the recommendations of the High Powered Committee appointed by Coal India Limited and the Ministry of Coal, and at rates notified by Coal India Limited from time to time. The Central Advisory Contract Labour Board retains the right to inspect the establishment to ensure compliance. The Management of Odisha Coal and Power Limited must ensure that existing contract workmen are given preference in employment by incoming contractors during changes, subject to satisfactory performance. Furthermore, the contractor and the Principal Employer must ensure payment of the High Powered Committee wages, which increase every six months, along with other benefits as per the provisions of the Mines Act, 1952 (35 of 1952). Contract workers shall also be covered under the provisions of the Payment of Gratuity Act, 1972 (39 of 1972), and receive bonus and leave with wages as per the Mines Act, 1952.

L.-33004/99 The Gazette of India CG-DL-E-16092025-266196 EXTRAORDINARY PART II-Section 3-Sub-section (ii) PUBLISHED BY AUTHORITY No. 4075] NEW DELHI, TUESDAY, SEPTEMBER 16, 2025/BHADRA 25, 1947 MINISTRY OF LABOUR AND EMPLOYMENT NOTIFICATION New Delhi, the 16th September, 2025 S.O. 4190(E).— In exercise of the powers conferred by section 31 of the Contract Labour (Regulation and Abolition) Act, 1970 (37 of 1970), the Central Government, after consultation with the Central Advisory Contract Labour Board, hereby exempts the Coal Mines allotted to the Odisha Coal and Power Limited, Zone-A, Ground Floor, Fortune Towers, Chandra sekharpur, Bhubaneswar-751023, namely the Manoharpur Coal Mine Project, Sundergarh, Odisha from the applicability of notification of the Government of India in the Ministry of Labour vide notification number S.O. 2063 dated the 21st June, 1988, published in the Gazette of India, Part II, section 3, sub-section (ii), in respect of employment of contract labour in the works specified in the Schedule to the said notification against serial numbers 1 to 3, for a period of three years from the date of publication of this notification in the Official Gazette subject to the following conditions, namely:- (i) The interest of the workmen engaged in the above mentioned works be protected; (ii) Such workmen be paid wages and other benefits as per the recommendations of the High Powered Committee appointed by the Coal India Limited, Ministry of Coal, Government of India and the rates notified by the Coal India Limited from time to time; (iii) The Central Advisory Contract Labour Board shall have the right to inspect the establishment to ensure and check whether such wages and benefits are given to such workers in the Odisha Coal and Power Limited, namely the Manoharpur Coal Mine Project, Sundergarh, Odisha; (iv) The Management of Odisha Coal and Power Limited shall ensure that whenever there is a change of contract, existing contract workmen who are working may be given preference in employment by the incoming contractor, subject to satisfactory performance of duties; (v) The workmen working in jobs ancillary or incidental to coal mining works specified against serial numbers 1 to 3 of the Schedule to the said notification number S.O. 2063(E), dated the 21st June, 1988, shall get wages as determined by the High Powered Committee appointed by the Coal India Limited, Ministry of Coal, Government of India and the rates notified by the Coal India Limited from time to time; (vi) The contractor, as well as the Principal Employer, shall ensure payment of the said High Powered Committee wages, which increases every six months, and also other benefits as per the provisions of the Mines Act, 1952 (35 of 1952); (vii) The contract workers shall be covered under the provisions of the Payment of Gratuity Act, 1972 (39 of 1972); and (viii) The contract workers shall be paid bonus and leave with wages as per the provisions of the Mines Act, 1952 (35 of 1952).
