The Ministry of Labour and Employment issued S.O. 3494(E) dated 16th August 2024, declaring, under sub-clause (vi) of clause (n) of section 2 of the Industrial Disputes Act, 1947 (14 of 1947), the services engaged in the industry of transport (other than railways), for carriage of passengers or goods by land or water, covered under item 1 of the First Schedule to the Act, to be a public utility service for the purposes of the Act for a period of six months from the date of publication of the notification; this follows an earlier declaration under notification S.O. 5030(E) dated 23rd November 2023, which had declared the same industry a public utility service for six months effective from 25th November 2023 and which could not be extended, and the Central Government determined that public interest required a renewed declaration; the notification, bearing file number S-11017/1/2009-IR(PL), is signed by Deepika Kachhal, Joint Secretary.

L.-33004/99 The Gazette of India CG-DL-E-16082024-256438 EXTRAORDINARY PART II-Section 3-Sub-section (ii) PUBLISHED BY AUTHORITY No. 3178] NEW DELHI, FRIDAY, AUGUST 16, 2024/SHRAVANA 25, 1946 MINISTRY OF LABOUR AND EMPLOYMENT NOTIFICATION New Delhi, the 16th August, 2024 S.O. 3494(E).— WHEREAS the Central Government is satisfied that public interest so requires that the services engaged in the industry of transport (other than railways) for the carriage of passengers or goods, by land or water, which is covered under item 1 of the First Schedule to the Industrial Disputes Act, 1947 (14 of 1947), to be a public utility service for the purposes of the said Act; AND WHEREAS the Central Government has declared the said industry to be public utility service for the purposes of the said Act for a period of six months from the 25th November, 2023 vide notification of the Government of India in the Ministry of Labour and Employment, number S.O. 5030(E), dated the 23rd November, 2023; AND WHEREAS the said declaration could not be extended at any one time; AND WHEREAS the Central Government is of the opinion that public interest requires that the said industry is declared public utility service for the purposes of the said Act for a period of six months; NOW, THEREFORE, in exercise of the powers conferred by sub-clause (vi) of clause (n) of section 2 of the Industrial Disputes Act, 1947 (14 of 1947), the Central Government being satisfied that public interest so requires, hereby declares the services engaged in the industry of transport (other than railways) for the carriage of passengers or goods, by land or water to be a public utility service for the purposes of the said Act for a period of six months from the date of publication of this notification in Official Gazette..
