The Central Government inserts new Para 2.20B and Para 11.64 into the Foreign Trade Policy (FTP) 2023 to prohibit the import of goods produced using forced labour and define 'Forced Labour' with immediate effect.

Detailed Summary

This notification, S.O. 3879(E), issued by the Ministry of Commerce and Industry (Department of Commerce), Directorate General of Foreign Trade, on July 13, 2026 (No. 23/2026-27), amends the Foreign Trade Policy (FTP) 2023. Exercising powers under Section 3 read with Section 5 of the Foreign Trade (Development & Regulation) Act, 1992, and paragraphs 1.02 and 2.01 of the FTP 2023, the Central Government inserts two new paragraphs with immediate effect. Firstly, Para 2.20B is added, prohibiting the import of goods produced, wholly or in part, using forced labour. It specifies that the Central Government may notify specific goods for prohibition, and the procedure for enquiry by the Director General of Foreign Trade is prescribed in the Handbook of Procedures, 2023. Secondly, a new Para 11.64 is inserted under Chapter 11 (Definition) of the FTP, 2023, defining "Forced Labour" as "all work or service which is exacted from any person under the menace of any penalty and for which the said person has not offered himself voluntarily," in accordance with the ILO Forced Labour Convention, 1930 (No. 29). This amendment aims to align the FTP with internationally recognised labour standards, strengthening India's commitment to ethical trade practices by enabling prohibitions on products related to forced labour, in addition to prison labour products. The notification was issued with the approval of the Minister of Commerce & Industry and signed by Lav Agarwal, Director General of Foreign Trade & Addl. Secy.
