application for registration is accepted, a certificate of registration shall be granted in appropriate forms, namely, Form V, Form VI, Form VII, Form VIII, Form VI (a), VI (b), VI (c), VI (d), VI (e), VI (f) or VI (g), as the case may be, and shall be subject to the terms and conditions specified in the respective certificate.". 4. In the principal rules, in rule 38, for sub-rule (1), the following sub-rule shall be substituted, namely: "38. Transfer of ownership of registered entities. – (1) Where any entity registered under rule 33 is transferred by way of sale, mortgage or any other method, the transferee shall, within one month from the date of such transfer, apply to the Secretary, Marine Products Export Development Authority for registering the transfer, accompanied by the instruments or the document evidencing such transfer.". 5. In the principal rules, in rule 39, for sub-rule (1), the following sub-rule shall be substituted, namely:- "(1) Where, during the period in which the registration of an entity under rule 33 is in force, the owner thereof intends- (a) to change place where the entity is located; (b) to alter the layout as approved by the Authority; (c) to effect any change in its capacity or otherwise; or (d) to change the place of operation of a fishing vessel or conveyance, the owner shall apply to the Secretary, Marine Products Export Development Authority at least thirty days in advance of such intended change.". 6. In the principal rules, in rule 41,- (i) after sub-rule (1), the following shall be inserted, namely:- "(1A) Every application for registration as a dealer of marine products, other than an exporter, shall be made to the Secretary, Marine Products Export Development Authority in Form XI available online, on payment of fee of rupees two hundred only and shall be accompanied by a certificate showing the financial status of the applicant from any bank."; (ii) for sub-rule (2), the following sub-rule shall be substituted, namely:- "(2) Every application for registration under sub-rules (1) and (1A) shall be accompanied by fee of rupees five thousand only.”. 7. In the principal rules, in rule 42, for sub- rule (3), the following sub- rule shall be substituted, namely:- "(3) Where an application for registration is accepted, the Secretary, Marine Products Export Development Authority shall grant a certificate of registration in Form X or Form XII, as the case may be, subject to conditions specified therein.”. 8. In the principal rules, rule 43 shall be renumbered as sub-rule (1) thereof and after sub-rule (1) as so renumbered the following sub-rules shall be inserted, namely:- "(2) Where the Secretary, Marine Products Export Development Authority is satisfied that any person has obtained a certificate of registration by furnishing false information or has contravened any of the provisions of these rules or conditions mentioned in the certificate of registration, such person thereby becomes disqualified to continue as a dealer. (3) The Secretary, Marine Products Export Development Authority may, after giving such person a reasonable opportunity of being heard, by order, cancel the registration and communicate a copy of such order.". 9. The ice plant owner shall maintain a quality assurance register denoting the production, linkage for supply, and the quality assurance of the water used and ice produced in the ice plant, which shall be made available to officers of the Authority for verification. 4. The ice plant owner shall get this certificate of registration revalidated on the expiry of its validity. 5. The transferee of the ice plant shall get the change of ownership endorsed in this certificate, in case the ownership is transferred. 6. The ice plant owner shall display a copy of this certificate in a prominent area in the ice plant. FORM VI (f) THE MARINE PRODUCTS EXPORT DEVELOPMENT AUTHORITY RULES, 1972. CONDITIONS OF REGISTRATION: 1. In case of any change in the layout, design or capacity is required, the owner should get it approved by the Authority. 2. The owner should comply with the regulations or any other instructions, in respect of handling, processing, packaging, preservation, storage and export of Other (Edible) marine products, issued by the Authority, from time to time. 3. The owner should use only the approved and food grade chemicals/ preservatives/ additives, if any required, while processing and packaging the products. 4. No chemical, detergent or repellent should be kept or stored in the processing /packing area of this establishment. 5. This establishment and its premises should be kept neat and tidy, sanitarily, and hygienically. 6. The owner should maintain this establishment always conforming to the standards prescribed or adopted by the Authority. 7. The owner should maintain a day-to-day account in a register showing the quantity of Other (Edible) marine products received, handled, processed, packed and exported and the register should be made available for inspection by officers of the MPEDA on demand. 8. A copy of this certificate should be prominently displayed in the establishment. 9. The validity of the Registration is for 3 years from the date of issue of Registration certificate, and the owner of the facility should get this certificate of registration renewed by the prescribed date for renewal. 10. Signature of the registering officer (Designation Seal) Place: Date: (Seal of the Authority) This certificate is issued subject to the provisions of the MPEDA Act and Rules 1972, the Export (Quality Control Inspection) Act 1963 and the subsequent Rules made thereof, and the conditions inscribed overleaf. CONDITIONS OF REGISTRATION: 1. In case of any change in the layout, design or capacity is required, the owner should get it approved by the Authority. 2. The owner should comply with the regulations or any other instructions, in respect of handling, processing, packaging, preservation, storage and export of Other (Non-edible) marine products, issued by the Authority, from time to time. 3. The owner should use only the approved chemicals, preservatives/ additives, if any required, while processing and packaging the products. 4. No chemical, detergent or repellant should be kept or stored in the processing / packing area of this establishment. 5. This establishment and its premises should be kept neat and tidy, Sanitary and Hygienic. 6. The owner should maintain this establishment always conforms to the standards prescribed or adopted by the Authority. 7. The owner should maintain a day-to-day accounts in a register showing the quantity of Other (Non-edible) marine products received, handled packed and exported and the register shall be made available for inspection by officers of the MPEDA on demand. 8. A copy of this certificate should be prominently displayed in the establishment. 9. The validity of the Registration is for 3 years from the date of issue of Registration certificate, and the owner of the facility shall have this certificate of registration renewed by the prescribed date for renewal. 10. The transferee should get the change of ownership endorsed in this certificate, in case the ownership is transferred". 12. This certificate of registration is granted subject to the provisions of the Marine Products Export Development Authority Rules, 1972, as amended from time to time. 2. The holder will abide by the Guidelines dated 23/07/2004 of Marine Products Export Development Authority for issue of Certificate of Registration as a dealer, as amended from time to time. 3. The dealer shall ensure that the quality of the marine products supplied by him conform to the specifications recognized by the Central Government under section 6 of the Export (Quality Control and Inspection) Act 1963 (21 of 1963) and Rules, regulations and instructions there under, as amended from time to time. 4. The dealer shall conform to the rules, regulations and instructions issued by the Export Inspection Council of India, Export Inspection Agency and the Authority from time to time in respect of procurement, packing, transportation, sanitary and other hygienic requirements. 5. The certificate is liable to be cancelled for any act of omission or commission by the holder, either in respect or quality issues or for trade related issues, including cheating, whether the complaint can be attributed to the dealer. 6. The registration shall cease to be valid if the holder becomes no longer entitled to such registration under the provisions of the Guidelines dated 23/07/2004 of Marine Products Export Development Authority for the issuance of a Certificate of Registration as a dealer, as amended from time to time. 7. The certificate holder shall indicate the name of the firm & MPEDA registration No. in all the documents related to dealing of marine products. 8. The dealer shall comply with such other instructions as may, from time to time be issued by the Government of India, the Authority, the Export Inspection Council of India and the Export Inspection Agency.".
