The Ministry of Textiles, vide S.O. 3916(E) dated 12 September 2024, in exercise of powers under sub-sections (1) and (2) of section 16 read with section 17 and sub-section (3) of section 25 of the Bureau of Indian Standards Act, 2016 (11 of 2016), and after consulting the Bureau of Indian Standards, issued the Protective Textiles Quality Control (Upholstered Composites used for Non-Domestic Furniture) Order, 2024, effective from the date of publication in the Official Gazette. The Order applies to goods specified in column (2) of its Schedule (excluding goods meant for export) and to upholstered composites or fabric traded as raw material or rolls, or used in assembling non-domestic furniture, though industries assembling non-domestic furniture using upholstered fabric as a component are exempted from the Order until 31 March 2025. Covered goods must conform to the corresponding Indian Standard in column (3) of the Schedule and bear the Standard Mark under a licence from the Bureau of Indian Standards in accordance with Scheme-I of Schedule-II to the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018, with the Bureau serving as certifying and enforcing authority. The Schedule specifies "Upholstered composites used for non-domestic furniture" against Indian Standard IS 15768:2008, "Textiles - Resistance to ignition of upholstered composites used for non-domestic furniture - Specification." Notes clarify that the latest published version of the Indian Standard applies from its publication date under clause (17) of section 2 of the BIS Act, 2016; that "non-domestic furniture" is to be defined per IS 15768:2008; that manufacturers/assemblers of furniture for domestic purposes may self-declare their products as meant for domestic requirements in lieu of compliance; and that the Order continues from the Protective Textiles (Quality Control) Amendment Order, 2024, published vide notification S.O. 3896(E) dated 12 September 2024. 5866 GI/202 4 (1) EXTRAORDINARY PART II —Section 3 —Sub-section ( ii) PUBLISHED BY AUTHORITY No. 3581 ] NEW DELHI, THURS DAY , SEPTEMBER 12, 2024/BHADRA 21, 1946 CG-DL-E-12092024-257111 (1) (2) (3) (4) MINISTRY OF TEXTILES ORDER New Delhi, the 12th September , 2024 S.O. 3916 (E).—In exercise of the powers conferred by sub -sections (1) and (2) of section 16 read with section 17 and sub -section (3) of section 25 of the Bureau of Indian Standards Act, 2016 (11 of 2016), the Central Government is of the opinion that it is necessary so to do in the public interest and after consulting the Bureau of Indian Standards, hereby makes the following Order, namely: - 1. Short title and commencement. – (1) This Order may be called the Protective Textiles Quality Control (Upholstered Composites used for Non -Domestic Furniture) Order, 2024. (2) It shall come into force on the date of its publication in the Official Gazette. 2. Application – This Order shall apply to : - (a) goods or articles specified in column (2) of the Schedule annexed to this Order, but shall not apply to such goods or article meant for export; (b) upholstered composites or fabric traded as raw material or rolls or used in assembly of non -domestic furniture : Provided that the industry dealing with the assembly of non - domestic furniture (manufacturing or importing) , wherein upholstered fabric is used as part of the finished furniture product shall be exempted from this Quality Control Order till 31st March 2025. 3. Compulsory use of Standard Mark. – The goods or article specified in column (2) of the said Schedule shall conform to the corresponding Indian Standard specified in column (3) thereof and shall bear the Standard Mark under a licence from the Bureau in accordance with Scheme -I of Schedule -II to the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018. 4. Certification and enforcement authority. – The Bureau shall be the certifying and enforcing authority in respect of the goods or article specified in column (2) of the said Schedule. SCHEDULE Sl. (2) Definition of “non - domestic furniture” with regards to this Order is to be referred from the standard IS 15768:2008 issued by Bureau of Indian Standards. (3) For the purpose and scope of this Order, any industry or firms who wish to manufacture or assemble upholstered furniture for domestic purposes shall have to give a Self - Declaration under IS 15768: 2008 that ‘their products are meant for domestic requirements’. This declaration is deemed sufficient for compliance purposes. (4) This Order issues in continuation to the Protective Textiles (Quality Control) Amendment Order, 2024 published in the Gazette of India, Extraordinary, Part II, Section 3, Sub – Section (ii), vide notification number S.O. 3896 (E) dated 12th September 2024.
