Core Purpose

The Central Government extends the period for submission of the report and decision by the Mahanadi Water Disputes Tribunal for nine months, effective from April 14, 2026, to January 13, 2027, under the proviso to sub-section (2) of section 5 of the Inter-State River Water Disputes Act, 1956.

Detailed Summary

The Ministry of Jal Shakti (Department of Water Resources, River Development and Ganga Rejuvenation) issued Notification S.O. 1858(E) on April 10, 2026, extending the deadline for the Mahanadi Water Disputes Tribunal. The Tribunal was constituted on March 12, 2018, by S.O. 1114(E) dated March 12, 2018, under section 4 of the Inter-State River Water Disputes Act, 1956 (33 of 1956), and was originally required to submit its report by March 11, 2021, under sub-section (2) of section 5 of the Act. An initial extension was granted via S.O. 2176 (E) dated June 3, 2021, extending the period until March 11, 2023. Subsequently, the Central Government, having considered directions from the Hon'ble Supreme Court and requests from the Tribunal, decided that the effective date of the Tribunal's constitution would be December 14, 2019 (the date of its first regular hearing) and that the period from March 2020 to June 2021 (sixteen months) would be treated as non-functional due to the COVID-19 pandemic. This adjustment deemed the three-year report submission period to expire on April 13, 2024. Consequently, a further extension was granted for two years, from April 14, 2024, to April 13, 2026. This current notification grants an additional nine-month extension, effective from April 14, 2026, until January 13, 2027, or until the report is submitted, whichever is earlier, due to a nine-month non-functional period following the resignation of then Chairman Mr. Justice A.M. Khanwilkar in March 2024, which resulted in a lack of quorum.
