No. P-31032/13/2023-Cement and S.O. 1153(E) issued in exercise of powers conferred by section 16 of the Bureau of Indian Standards Act, 2016 (11 of 2016) after consulting the Bureau of Indian Standards, promulgated the Gypsum based Building Materials (Quality Control) Order, 2024, which comes into force six months after publication and requires gypsum plaster boards (IS 2095 Part 1:2011), gypsum plaster boards/glass fibre reinforced gypsum panels (IS 17400:2021), coated/laminated gypsum plaster boards (IS 2692:1989), and reinforced gypsum plaster boards/ceiling tiles (IS 2095 Part 3:2022) to conform to the specified Indian Standards and bear the BIS Standard Mark under a licence per Scheme-I of Schedule-II of the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018, with the Bureau of Indian Standards as certifying and enforcing authority and penalties under the BIS Act, 2016 for contravention; the Order exempts goods manufactured domestically for export, and grants small enterprises (as defined under clause (m) of section 2 of the Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006)) a nine-month exemption and micro enterprises (clause (h) of section 2) a twelve-month exemption from the date of publication. Short title and commencement.—(1) This Order may be called the Gypsum based Building Materials (Quality Control) Order, 2024. (2) It shall come into force on expiry of six month from the date of publication of this notification in the Official Gazette.: 2. Compulsory use of Standard Mark.—Goods or articles specified in Column (1) of the Table shall conform to the corresponding Indian Standards specified in Column (2) of the said Table and shall bear the Standard Mark under a licence from the Bureau of Indian Standards as per Scheme-I of Schedule-II of the Bureau of Indian Standards (Conformity Assessment) Regulations, 2018: [PART II—SECTION 3(ii)] THE GAZETTE OF INDIA : EXTRAORDINARY 3 Provided that nothing in this Order shall apply to goods or articles manufactured domestically meant for export: Provided further that nothing in this order shall apply to small enterprises, as defined under clause (m) of section 2 of the Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006), till the expiry of nine month from the date of publication of this notification: Provided also that nothing in this order shall apply to micro enterprises, as defined under clause (h) of section 2 of the Micro, Small and Medium Enterprises Development Act, 2006 (27 of 2006), till the expiry of twelve month from the date of publication of this notification: 3. Certification and enforcement authority.—The Bureau of Indian Standards shall be the certifying and enforcing authority for the goods or articles specified in the Table. 4. Penalty for Contravention.—Any person who contravenes the provisions of this Order shall be punishable under the provisions of the Bureau of Indian Standards Act, 2016.
