No. HR-12012/1/2022-HR-FSSAI.—The following draft of certain regulations further to amend the Food Safety and Standards Authority of India (Salary, Allowances and other Conditions of Service of officers and Employees) Regulations, 2013, which the Food Safety and Standards Authority of India proposes to make with previous approval of the Central Government, in exercise of the powers conferred by clause (a) of sub-section (2) of section 92 read with sub-section (3) of section 9 of the Food Safety and Standards Act, 2006 (34 of 2006) is hereby published as requiredunder sub-section (1) of section 92 of the said Act for the information of all persons likely to be affected thereby and notice is hereby given that the said draft regulations shall be taken into consideration after the expiry of the period of thirty days from the date on which copies of the Gazette containing this notification are made available to the public. Objections or suggestions, if any, may be addressed to the Chief Executive Officer, Food Safety and Standards Authority of India, FDA Bhawan, Kotla Road, New Delhi- 110002 or sent on email at [email protected] Objections or suggestions, which may be received from any person with respect to the said draft regulations before the expiry of period so specified, shall be considered by the Food Safety and Standards Authority of India. Draft Regulations 1. These regulations may be called the Food Safety and Standards Authority of India (Salary, Allowances and other Conditions of Service of officers and Employees) Amendment Regulations, 2024. 2. In the Food Safety and Standards Authority of India (Salary, Allowances and other Conditions of Service of officers and Employees) Regulations, 2013, (herein after referred as said regulations), (1) in regulation 2 relating to "Definitions",- a. in sub-regulation (g) relating to "appointing authority",- i. in clause (i), for the words and figures "Grade Pay of Rs. 10,000“, the words and figures“Pay Level of 14 in the 7th CPC Pay Matrix” shall be substituted. ii. in clause (ii), for the words and figures "grade Pay of less than Rs. 10,000", the words and figures "Pay Level less than 14 in 7th CPC Pay Matrix;" shall be substituted; iii. in clause (iii), for the words "the Chief Management Services Officer", the words "the Executive Director (HR)" shall be substituted"; b. in sub-regulation (h) relating to definition of "disciplinary authority", - (i) in clause (i), for the words and figures “Grade Pay of Rs. 10,000“, the words and figures "Pay Level of 14 in the 7th CPC Pay Matrix" shall be substituted. (ii) in clause (ii), for the words and figures "Grade Pay of less than Rs. 10,000", the words and figures "Pay Level less than 14 in 7th CPC Pay Matrix;" shall be substituted; (iii) in clause (iii), for the words "the Chief Management Services Officer", the words "the Executive Director (HR)" shall be substituted; c. after sub-regulation (h), following sub-regulation shall be inserted, namely,-“(ha) "appellate authority" means,- i. The Secretary, Ministry of Health and Family Welfare in respect of all posts equivalentto Group 'A' posts carrying the Pay Level of 14 in 7th CPC Pay Matrix or above but does not include the Chief Executive Officer; ii. The Chairperson of the Authority in respect of all posts equivalent to Group 'A' carrying the Pay Level less than 14 in the 7th CPC Pay Matrix; iii. The Chief Executive Officer of the Authority in respect of all posts equivalent to Group 'B' and iv. The Executive Director (HR) of the Authority in respect of all posts equivalent to Group 'C' "; d. sub-regulation (k) shall be omitted; e. after sub-regulation (n), following sub-regulation shall be inserted, namely,- "(o) 'Resignation' means as specified by the Department of Personnel & Training from time to time; (p)'Technical Resignation' means as specified by the Department of Personnel & Training from time to time." (2) in regulation 3 relating to "Conditions of Service",- a. after the words "condition of services", the words "including gratuity, pension andretirement benefits" shall be inserted; b. after the existing proviso, the following proviso shall be inserted, namely,- "Provided further that separate provisions may be made by the Food Authority for themedical, housing or any other facilities/allowances that it deems fit."; c. after regulation 3, the following regulation shall be inserted, namely,- "(3A) "Resignation from the services of Authority"- A resignation has to be clear and unconditional. A temporary employee (probationer) will give a notice of one month before resignation or deposit amount of one month pay at the time of resignation and a regular employee will give a notice of three months before resignation or deposit amountof three months' pay at the time of resignation: Provided that in case of regular employee, the Competent Authority will take decision on retaining lien to the post as per Department of Personnel & Training order or guidelines or memorandum issued from time to time. Provided further that competent authority may waive off the notice period or depositionof pay, if he thinks fit.". (3) Sub-regulation (3) of regulation 4 shall be omitted. (4) in regulation 8 relating to "Saving clause", after the words "Other Backward Classes", the words "Economically Weaker Sections" shall be inserted. G.
