Core Purpose

The Food Safety and Standards Authority of India (FSSAI) hereby makes the Food Safety and Standards (Licensing and Registration of Food Businesses) second Amendment Regulations, 2026, to further amend the Food Safety and Standards (Licensing and Registration of Food Businesses) Regulations, 2011.

Detailed Summary

The Food Safety and Standards Authority of India (FSSAI), with the previous approval of the Central Government, issued the Food Safety and Standards (Licensing and Registration of Food Businesses) second Amendment Regulations, 2026, on 23rd June, 2026, under F. No. REG-11013/1/2026-Regulation-FSSAI. These regulations, effective from their publication date in the official Gazette, amend the Food Safety and Standards (Licensing and Registration of Food Businesses) Regulations, 2011. The amendments follow the publication of a draft on 23rd January, 2026 (F.No. REG-11013/1/2026-Regulation-FSSAI) in the Gazette of India, Extraordinary, Part III, section 4, dated 27th January, 2026, inviting public objections and suggestions, which were subsequently considered by FSSAI. Key changes include the substitution of serial number 8 in Schedule 2, Annexure 3, under 'Conditions of License,' to mandate maintaining daily records of production and raw material utilization separately, with an exemption for non-manufacturing food businesses. Additionally, paragraph 5.2.5 in Schedule 4, Part-II, under 'FOOD OPERATIONS AND CONTROLS,' is updated to require 'First in First out, First Expire First Out' storage for raw materials, ingredients, work-in-progress, and processed/cooked/packaged food products, excluding retailers. The 2011 Regulations were originally published on 1st August, 2011 (F. No. 2-15015/30/2010) and last amended on 10th March, 2026 (F. No. RCD-01002/ 1/ 2021-Regulatory-FSSAI-Part(1)). The regulations are issued in exercise of powers conferred by clause (o) of sub-section (2) of section 92 read with section 31 of the Food Safety and Standards Act, 2006 (34 of 2006).
