Detailed Summary

In exercise of the powers conferred by the proviso to sub-clause (vi) of clause (n) of section 2 of the Industrial Disputes Act, 1947 (14 of 1947), the Ministry of Labour and Employment declared the industrial establishments manufacturing or producing Nuclear Fuel and components, Heavy Water and Allied Chemicals, and Atomic Energy, covered under item 28 of the First Schedule to the Act, to continue as a public utility service for a further period of six months with effect from 28th December 2023. This extends the earlier declaration made vide notification S.O. 2790(E) dated 27th June 2023, which had declared the same establishments a public utility service for six months from 28th June 2023. The current notification, S.O. 5157(E), was issued on 4th December 2023 under F. No. S-11017/3/97-IR(PL) and signed by Deepika Kachhal, Joint Secretary.

7480 GI/202 3 (1) EXTRAORDINARY PART II —Section 3 —Sub-section ( ii) PUBLISHED BY AUTHORITY No. 4932] NEW DELHI, MONDAY, DECEMBER 4, 2023/AGRAHAYANA 13 , 194 5 CG-DL-E-05122023-250415 MINISTRY OF LABOUR AND EMPLOYMENT NOTIFICATION New Delhi, the 4th December , 2023 S.O. 5 157(E).—Whereas the Central Government is satisfied that the public interest so requires that the services engaged in the Industrial establishments manufacturing or producing Nuclear Fuel and components, Heavy Water and Allied Chemicals and Atomic Energy, which are covered under item 28 of the First Schedule to the Industrial Disputes Act, 19 47 (14 of 1947), to be a public utility service for the purposes of the said Act; And whereas the Central Government has lastly declared the said industrial establishments to be a public utility service for the purposes of the said Act for a period of six months from the 28th June, 2023 vide notification of the Government of India in the Ministry of Labour and Employment number S.O. 2790(E), dated the 27th June, 2023; And whereas the Central Government is of the opinion that public interest requires the e xtension of the public utility service status to the said industrial establishments for a further period of six months; Now, therefore, in exercise of the powers conferred by the proviso to sub -clause (vi) of clause (n) of section 2 of the Industrial Disp utes Act, 1947 (14 of 1947), the Central Government hereby declares the services engaged in the said industrial establishments to be a public utility service for the purposes of the said Act for a period of six months with effect from the 28th December, 20 23.
