Detailed Summary

The Ministry of Labour and Employment, by notification S.O. 5156(E) dated 4 December 2023 (F. No. S-11017/8/2011-IR(PL)), in exercise of powers under the proviso to sub-clause (vi) of clause (n) of Section 2 of the Industrial Disputes Act, 1947 (14 of 1947), declared, being satisfied that public interest so required, that the services engaged in the industry of defence establishments—covered under Item 8 of the First Schedule to the said Act—shall continue to be a "public utility service" for the purposes of the Act, for a further period of six months with effect from 24 December 2023. The Central Government had previously declared the same industry a public utility service for a period of six months from 24 June 2023, by notification S.O. 2430(E) dated 5 June 2023, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii); the present notification is issued on the Central Government's opinion that public interest requires extending that status further. 7479 GI/202 3 (1) EXTRAORDINARY PART II —Section 3 —Sub-section ( ii) PUBLISHED BY AUTHORITY No. 4931] NEW DELHI, MONDAY, DECEMBER 4, 2023/AGRAHAYANA 13 , 194 5 CG-DL-E-05122023-250414 MINISTRY OF LABOUR AND EMPLOYMENT NOTIFICATION New Delhi, the 4th December , 2023 S.O. 5 156(E).—Whereas the Central Government is satisfied that the public interest so requires that the services engaged in the industry of defence establis hments, which is covered under item 8 of the First Schedule to the Industrial Disputes Act, 1947 (14 of 1947), to be a public utility service for the purposes of the said Act; And whereas the Central Government had lastly declared the said industry to be p ublic utility service for the purposes of the said Act for a period of six months from the 24th June, 2023 vide notification of the Government of India in the Ministry of Labour and Employment, published in the Gazette of India, Extraordinary, Part II, Sec tion 3, Sub -Section (ii) vide number S.O. 2430 (E), dated the 5th June, 2023; And whereas the Central Government is of the opinion that public interest requires the extension of the public utility service status to the said industry for a further period of six months; Now, therefore, in exercise of the powers conferred by the proviso to sub -clause (vi) of clause (n) of section 2 of the Industrial Disputes Act, 1947 (14 of 1947), the Central Government hereby declares the services engaged in the industry o f defence establishments to be a public utility service for the purposes of the said Act for a period of six months with effect from the 24th December, 2023.
