The Department for Promotion of Industry and Internal Trade, Ministry of Commerce and Industry, vide G.S.R. 312(E) dated 3rd June 2024, in exercise of powers conferred by Section 4 of the Petroleum Act, 1934 (30 of 1934), notifies the Calcium Carbide (Amendment) Rules, 2024, further amending the Calcium Carbide Rules, 1987, following publication of draft rules under Section 29(2) of the Petroleum Act vide G.S.R. 835(E) dated 14th November 2023 (made available to the public on 14th November 2023) with no objections received. The amendment, effective on final publication in the Official Gazette, omits the words 'in quantities' from the proviso to Rule 4; substitutes the proviso to Rule 26 to exempt from licensing requirements the temporary storage of calcium carbide within port limits under conditions specified by the Conservator of the port, storage while in transit under custody of railway administration or road transport agency, and storage in the possession of the Defence Forces of the Union; and inserts a new proviso to Rule 27(1) prescribing storage conditions for calcium carbide quantities not exceeding five kilograms (in receptacles each containing not more than one kilogram) and quantities exceeding five kilograms but not exceeding two hundred kilograms (in receptacles within a dry, ventilated storage shed with restricted access). The principal rules were published vide G.S.R. 105(E) dated 18th February 1987 and previously amended vide G.S.R. 109(E) dated 28th February 1990, G.S.R. 647(E) dated 20th August 2015, G.S.R. 1094(E) dated 8th November 2018, and G.S.R. 610(E) dated 31st August 2021. L.-33004/99 The Gazette of India CG-DL-E-05062024-254564 EXTRAORDINARY PART II—Section 3—Sub-section (i) PUBLISHED BY AUTHORITY No. 291] NEW DELHI, WEDNESDAY, JUNE 5, 2024/JYAISHTHA 15, 1946 MINISTRY OF COMMERCE AND INDUSTRY (Department for Promotion of Industry and Internal Trade) NOTIFICATION New Delhi, the 3rd June, 2024 G.S.R. 312(E).—Whereas, the draft rules to amend the Calcium Carbide Rules, 1987, were published as required by Sub-Section (2) of Section 29 of the Petroleum Act 1934 (30 of 1934), vide notification number G.S.R. 835(E), dated the 14th November, 2023, in the Gazette of India, Extraordinary, Part-II, Section 3, Sub-section (i), inviting objections and suggestions from all persons likely to be affected thereby before the expiry of forty-five days from the date on which the notification was made available to the public; And whereas the said notification was made available to the public on the 14th November, 2023; And whereas no objection and suggestions were received from the public on the said draft rules by the Central Government; Now, therefore, in exercise of the powers conferred by Section 4 of the Petroleum Act, 1934, the Central Government hereby makes the following rules further to amend the Calcium Carbide Rules, 1987, namely: - 1. (1) These rules may be called the Calcium Carbide (Amendment) Rules, 2024 (2) They shall come into force on the date of their final publication in the Official Gazette. 2. In the Calcium Carbide Rules, 1987 (hereinafter referred to as the said rules), in Rule 4, in the proviso, the words "in quantities" shall be omitted. 3. In rule 26 of the said rules, for the proviso, the following proviso shall be substituted namely:- "Provided that no licence shall be required for storage of calcium carbide – (a) temporarily within port limits under such conditions as the Conservator of the port may specify, (b) while in transit under the custody of railway administration or road transport agency; (c) in the possession of the Defence Forces of the Union". 4. In rule 27 of the said rules, in sub-rule (1), the following proviso shall be inserted namely:- "Provided that calcium carbide- (a in any quantity not exceeding five kilograms shall be stored in prescribed receptacles each containing not more than one kilogram; and (b) in any quantity exceeding five kilograms but not exceeding two hundred kilograms shall be stored,- (i) in receptacles stored in a dry and well ventilated storage shed, which may form a part of or attached to a building that it is separated there from by a substantial partition and the only means of access to it is from outside air; (ii) due precautions shall be taken to prevent unauthorised persons from having access to the receptacles; (iii) the receptacles shall be kept securely closed except while taking out carbide there from."
