The Ministry of AYUSH, through Notification G.S.R. 440(E) dated 3rd June, 2026, exercised powers under clauses (a) to (i), (o) and (p) of sub-section (2) of section 54 of the National Commission for Indian System of Medicine Act, 2020 (14 of 2020) to amend the National Commission for Indian System of Medicine (Manner of Appointment and Nomination of Members, Their Salary, Allowances and Terms and Conditions of Service, and Declaration of Assets, Professional and Commercial Engagements) Rules, 2020. The amendments, known as the National Commission for Indian System of Medicine (Manner of Appointment and Nomination of Members, Their Salary, Allowances and Terms and Conditions of Service, and Declaration of Assets, Professional and Commercial Engagements) Amendment Rules, 2026, come into force from their publication date in the Official Gazette. Key changes include: an explanation inserted in rule 5(2) clarifying that the Chairperson's appointment from Central/State/Union territory service is treated as deputation; rule 10(1) is substituted to state the Chairperson is governed by Contributory Provident Fund Rules (India), 1962 or Employees' Provident Funds and the Miscellaneous Provisions Act, 1952 (19 of 1952) if General Provident Fund (Central Services) Rules, 1960 option is unavailable; an explanation inserted in rule 13(2) clarifying that the President or Member of Autonomous Boards' appointment from Central/State/Union territory service is treated as deputation; rule 18(1) is substituted to state the President and Members of Autonomous Boards are governed by Contributory Provident Fund Rules (India), 1962 or Employees' Provident Funds and the Miscellaneous Provisions Act, 1952 (19 of 1952) if General Provident Fund (Central Services) Rules, 1960 option is unavailable; and in rule 20, a new sub-rule (1A) is inserted regarding the Secretary to the Commission's salary and allowances if from Central/State/Union territory service, along with an explanation treating such appointment as deputation, and in sub-rule (2)(ii), "fifteen years" is substituted with "seven years". The principal rules were initially published vide G.S.R.771(E) dated 18th December, 2020, and subsequently amended vide G.S.R 116(E) dated 14th February, 2022.

L.-33004/99 The Gazette of India CG-DL-E-04062026-273141 EXTRAORDINARY PART II—Section 3—Sub-section (i) PUBLISHED BY AUTHORITY No. 393] NEW DELHI, THURSDAY, JUNE 4, 2026/JYAISTHA 14, 1948 MINISTRY OF AYUSH NOTIFICATION New Delhi, the 3rd June, 2026 G.S.R. 440(E).— In exercise of the powers conferred by clauses (a), (b), (c), (d), (e), (f), (g), (h), (i), (o) and (p) of sub-section (2) of section 54 of the National Commission for Indian System of Medicine Act, 2020 (14 of 2020), the Central Government hereby makes the following rules, further to amend the National Commission for Indian System of Medicine (Manner of Appointment and Nomination of Members, Their Salary, Allowances and Terms and Conditions of Service, and Declaration of Assets, Professional and Commercial Engagements) Rules, 2020, namely:- 1. (1) These Rules may be called the National Commission for Indian System of Medicine (Manner of Appointment and Nomination of Members, Their Salary, Allowances and Terms and Conditions of Service, and Declaration of Assets, Professional and Commercial Engagements) Amendment Rules, 2026. (2) They shall come into force from the date of their publication in Official Gazette. 2. In the National Commission for Indian System of Medicine (Manner of Appointment and Nomination of Members, Their Salary, Allowances and Terms and Conditions of Service, and Declaration of Assets, Professional and Commercial Engagements) Rules, 2020,- (a) in rule 5, in sub-rule (2), the following Explanation shall be inserted, namely:- "Explanation.- For the purposes of this sub-rule, it is clarified that where, the Chairperson is in the service of the Central Government or a State Government or Union territory Administration, his appointment in the Commission shall be treated as on deputation."; (b) in rule 10, for sub-rule(1), the following sub-rule shall be substituted, namely :- "(1) The Chairperson of the Commission shall be governed by the provisions of the Contributory Provident Fund Rules (India), 1962 or the Employees' Provident Funds and the Miscellaneous Provisions Act, 1952 (19 of 1952), as the case may be, where no option to subscribe under the General Provident Fund (Central Services) Rules, 1960 is available."; (c) in rule 13, in sub-rule (2), the following Explanation shall be inserted, namely:- "Explanation.- For the purposes of this sub-rule, it is clarified that where the President or Member is in the service of the Central Government or a State Government or Union territory Administration, his appointment in Autonomous Boards shall be treated as on deputation."; (d) in rule 18, for sub-rule(1), the following sub-rule shall be substituted, namely :- "(1) The President and Members of the Autonomous Boards shall be governed by the provisions of the Contributory Provident Fund Rules (India), 1962 or the Employees' Provident Funds and the Miscellaneous Provisions Act, 1952(19 of 1952), as the case may be, where no option to subscribe under the General Provident Fund (Central Services) Rules, 1960 is available."; (e) in rule 20,- (i) after sub-rule (1), the following sub-rule shall be inserted, namely: - "(1A) If the Secretary to the Commission is in service of the Central Government or a State Government or Union territory Administration, his salary and allowances shall be regulated in accordance with the rules applicable to him or sub-rule (1), whichever is higher. "Explanation.- For the purposes of this sub-rule, it is clarified that where the Secretary is in the service of the Central Government or a State Government or Union territory Administration, his appointment in the Commission shall be treated as on deputation."; (ii) sub-rule (2), in clause (ii), for the words "fifteen years", the words “seven years" shall be substituted.".
