                Detailed Summary
            

            
The Ministry of Commerce and Industry, Department of Commerce, Directorate General of Foreign Trade, issued Notification No. 03/2026-27 (S.O. 1732(E)) on April 2, 2026, exercising powers under Sections 3 and 5 of the Foreign Trade (Development & Regulation) Act, 1992, read with paragraphs 1.02 and 2.01 of the Foreign Trade Policy, 2023. The Central Government has amended Chapter 71 of Schedule-1 (Import Policy) of ITC (HS) 2022. A new Policy Condition No. 07 is introduced, exempting imports by 100% Export Oriented Units (EOUs) and units in Special Economic Zones (SEZs) from these restrictions, provided the imported goods are not sold into the Domestic Tariff Area (DTAs), as per Para 6.01(d) of FTP, 2023 and Rule 27 of the Special Economic Zones (SEZ) Rules, 2006. Imports under schemes for export of Gems and Jewellery (Chapter-4 of FTP, 2023) are also exempt. Specific ITC (HS) codes for base metals clad with gold, platinum (unwrought, powder, other forms), base metals/silver/gold clad with platinum, articles of goldsmiths/silversmiths wares (of silver, gold, platinum, or base metal clad with precious metal), catalysts of platinum, laboratory/industrial articles, spinnerets, and certain coins have their import policies revised from 'Free' to 'Restricted' or 'Restricted' to 'Free', with most now subject to Policy Condition No. 7. Notably, imports of Platinum alloy consisting of gold more than 1% by weight, and items with Silver or Gold more than 1% by weight, are specifically restricted under certain codes. This notification explicitly states that transitional arrangements under Para 1.05(b) of the Foreign Trade Policy, 2023, or any other provision, shall not apply, and the amended policy comes into force immediately, irrespective of any prior contract, irrevocable letter of credit, advance payment, or shipment status. This issuance is approved by the Minister of Commerce & Industry and signed by Lav Agarwal, Director General of Foreign Trade & Ex-officio Addl. Subject: Amendment in Import Policy and Policy conditions of items covered under Chapter 71 of ITC (HS)
2022, Schedule-I (Import Policy)-reg.

S.O. 1732(E).—In exercise of powers conferred by Section 3 and Section 5 of Foreign Trade
(Development & Regulation) Act, 1992, read with paragraph 1.02 and 2.01 of the Foreign Trade Policy, 2023, as
amended from time to time, the Central Government hereby makes the following amendments under Chapter 71 of
Schedule-1(Import Policy) of ITC (HS) 2022with immediate effect:
2. Policy Condition no. 07 of the Chapter 71 is introduced as under:
    "Imports by 100% Export Oriented Units and units located in Special Economic Zones (SEZs) shall not be
    subject to the above restrictions as per Para 6.01(d) of FTP, 2023 and under Rule 27 of the Special Economic
    Zones (SEZ) Rules, 2006 respectively, provided such imported goods are not sold into the Domestic Tarifff
    Area (DTAs). Further, imports under the schemes for export of Gems and Jewellery under Chapter-4 of FTP,
    2023 shall also be exempt from these restrictions."

2. Notwithstanding anything contained in Para 1.05(b) of the Foreign Trade Policy, 2023, (FTP) or any other
provision, the benefit of transitional arrangements shall not apply to the restrictions imposed under this
Notification.
3. The import policy as amended above shall come into force with immediate effect and shall apply irrespective of
any prior contract, irrevocable letter of credit, advance payment, or shipment status.
Effect of the Notification: The Import Policy and Policy Condition of items as mentioned above covered under
Chapter 71 of ITC HS, 2022, Schedule-I (Import Policy)is revised as mentioned above with immediate effect. These
restrictions shall apply notwithstanding Para 1.05(b) of FTP 2023 and shall operate irrespective of any prior
contract, irrevocable letter of credit, advance payment, shipment status, or any other commitment whatsoever.
Accordingly, the benefit of transitional arrangements shall not be available.
This is issued with the approval of the Minister of Commerce & Industry.
