Detailed Summary

The Ministry of Labour and Employment, in S.O. 422(E) dated 2nd February 2024, records that industries engaged in manufacturing of Alumina and Aluminium and mining of Bauxite, covered under items 30 and 31 respectively of the First Schedule to the Industrial Disputes Act, 1947 (14 of 1947), had last been declared public utility services for a period of six months from 4th August 2023 vide Notification S.O. 3504(E) dated 4th August 2023; being of the opinion that public interest requires further extension, the Central Government, exercising powers under the proviso to sub-clause (vi) of clause (n) of section 2 of the Industrial Disputes Act, 1947, declares the services of the said industries to be public utility services for a further period of six months with effect from 4th February 2024; the notification is signed by Deepika Kachhal, Joint Secretary, under File No. S-11017/03/2024-IR(PL).

L.-33004/99 The Gazette of India CG-DL-E-02022024-251739 EXTRAORDINARY PART II-Section 3-Sub-section (ii) PUBLISHED BY AUTHORITY No. 398] NEW DELHI, FRIDAY, FEBRUARY 2, 2024/MAGHA 13, 1945 MINISTRY OF LABOUR AND EMPLOYMENT NOTIFICATION New Delhi, the 2nd February, 2024 S.O. 422(E).—Whereas the Central Government is satisfied that public interest so requires that the services of industries engaged in Manufacturing of Alumina and Aluminium and Mining of Bauxite, which are covered under items 30 and 31, respectively, of the First Schedule to the Industrial Disputes Act, 1947 (14 of 1947), to be a public utility service for the purposes of the said Act; And whereas the Central Government has lastly declared the said industries to be public utility services for the purposes of the said Act for a period of six months from the 4th August, 2023, vide notification of the Government of India in the Ministry of Labour and Employment, number S.O. 3504(E), dated the 4th August, 2023; And whereas the Central Government is of the opinion that public interest requires the extension of the public utility service status to the said industries for a further period of six months; Now, therefore, in exercise of the powers conferred by the proviso to sub-clause (vi) of clause (n) of section 2 of the Industrial Disputes Act, 1947 (14 of 1947), the Central Government hereby declares the services of the said industries to be public utility services for the purposes of the said Act for a period of six months with effect from the 4th February, 2024.
