Under G.S.R. 302(E) dated 31st May 2024, exercising powers under the proviso to Article 309 of the Constitution, the President made the Ministry of Labour and Employment, Directorate General of Mines Safety, Private Secretary (Group 'B' Post) Recruitment Rules, 2024, superseding the Directorate General of Mines Safety (Group 'A' and Group 'B' Posts) Recruitment Rules, 1980 insofar as they relate to the post of Senior Personal Assistant (now redesignated Private Secretary); the rules take effect from the date of publication in the Official Gazette and set out, via the annexed Schedule, that there are 11 posts (2024, subject to workload variation) classified as General Central Service, Group 'B', Gazetted, Ministerial, in Level 7 of the pay matrix (Rs.44900-142400), filled by promotion (a Selection Post) from Stenographer Grade-I (Level 6 pay matrix, Rs.35400-112400) with five years' regular service and completion of a two-week training in establishment rules/computer proficiency, with promotion cases considered by a Departmental Promotion Committee comprising the Director General of Mines Safety (Chairman), the Deputy Director General of Mines Safety (Member), and the Director (Administration)/Director of Mines Safety (Member); Union Public Service Commission consultation is not required; the rules also bar appointment to persons with a living spouse who contract another marriage (subject to exemption for personal-law-permitted marriages), allow the Central Government to relax provisions for any class of persons, and preserve existing reservation and age-relaxation concessions for Scheduled Castes, Scheduled Tribes and other special categories; the notification (F.No. A-12018/03/2022-ISH-II) was signed by Deepika Kachhal, Joint Secretary.

L.-33004/99 The Gazette of India CG-DL-E-01062024-254501 EXTRAORDINARY PART II—Section 3—Sub-section (i) PUBLISHED BY AUTHORITY No. 281] NEW DELHI, FRIDAY, MAY 31, 2024/JYAISHTHA 10, 1946 3326 GI/2024 [F.No. A-12018/03/2022-ISH-II)] MINISTRY OF LABOUR AND EMPLOYMENT NOTIFICATION New Delhi, the 31st May, 2024 G.S.R. 302(E).—In exercise of the power conferred by proviso to article 309 of the constitution, and in supersession of the Directorate General of Mines Safety (Group 'A' and Group 'B' posts) Recruitment Rules, 1980, in so far as they relate to the post of the Senior Personal Assistant, except as respects things done or omitted to be done before such supersession, the President hereby makes the following rules regulating the method of recruitment for the post of the Private Secretary in Directorate General of Mines Safety under Ministry of Labour & Employment, namely:- 1. Short title and commencement.—(1) These rules may be called the Ministry of Labour and Employment, Directorate General of Mines Safety, Private Secretary (Group 'B' Post) Recruitment Rules, 2024. (2) They shall come into force on the date of their publication in the official Gazette. 2. Number of posts, classification and level in the pay matrix. The number of said posts, its classification and the scale of pay attached thereto, shall be as specified in columns (2) to (4) of the schedule to these rules. 3. Method of recruitment, age-limit and other qualifications etc. The method of recruitment, age-limit, qualifications and other matters relating thereto, shall be as specified in columns (5) to (13) of the said schedule. 4. Disqualification. -No person,- (a) Who has entered into or contracted a marriage with a person having a spouse living, or (b) Who, having a spouse living, has entered into or contracted a marriage with any person, shall be eligible for appointment to any of the said posts: Provided that the Government may, if satisfied that such marriage is permissible under the personal law applicable to such person and the other party to the marriage and that there are other grounds for doing so, exempt any person from the operation of this rule. 5. Power to relax.—Where the Central Government is of the opinion that it is necessary or expedient to do so, it may, by order, for reasons to be recorded in writing, and in consultation with the Union Public Service Commission, relax any of the provisions of these rules with respect to any class or category or persons. 6. Saving. Nothing in these rules shall affect reservations, relaxation of age-limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes and other special categories of persons, in accordance with the orders issued by the Central Government from time to time in this regard. Note: Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their senior would also be considered provided they are not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less and have successfully completed probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying/eligibility service. If a Departmental Promotion Committee exists, what is its composition 12 Departmental Promotion Committee (for considering promotion) consisting of:- 1. Director General of Mines Safety Chairman; 2. Deputy Director General of Mines Safety Member; 3. Director (Administration) or Director of Mines Safety or Director of Mines Safety (In- charge of Administration) – Member.
