No. 326 PART IV GOVERNMENT OF THE NATIONAL CAPITAL TERRITORY OF DELHI REVENUE DEPARTMENT, LAND BRANCH NOTIFICATION Delhi, the 6th January, 2025 No. F. 202/SDM-II (HQ)/Land/2024/087759789/05.—In supersession of earlier Notification No. 205 dated 02.08.2024 issued in Extra Ordinary Delhi Gazette and in exercise of the powers conferred under section 67, 68 and 164 of the Electricity Act, 2003, read with section 10, 11 and 16 of Indian Telegraph Act, 1885 and notification issued by Ministry of Power, Government of India, S.O. No 1463(E) dated 24.12.2003, the Lt. Governor of National Capital Territory of Delhi hereby lays down the policy for determination of the compensation for the purpose of laying transmission lines supported by a tower base of 66 KV voltage level and above, which is as under: 1. (a) Compensation for “Area under the Tower” : Licensee shall pay compensation at the double rate (200%) of the land value at circle rate for agricultural land or double the rate (200%) of the average rate of agricultural land in the sale/ purchase in the last 03 years immediately preceding the year in which compensation is finalized by the DM, whichever is more. (b) Compensation for the area under corridor i.e area between the towers /RoW Corridor : The Licensee shall also pay compensation at the rate of 30% of the land value at circle rate for agricultural land or 30% of the average rate of agricultural land in the sale/purchase in last 03 years immediately preceding the year in which compensation is finalized by the DM, whichever is more, for diminution of land and for "No Use Allowance" for the area occupied by the line corridor of high tension line. Land within the RoW corridor, as defined in Schedule VII of the Central Electricity Authority (Technical Standards for Construction of Electrical Plants and Electric Lines) Regulations, 2022 (Annexure-I) shall be eligible for compensation. This compensation will address the potential diminution of land value due to the presence of overhead lines or underground cables within the RoW corridor. No construction activity of any kind would be permitted within the RoW of the transmission line. 2. Compensation towards Crop/Tree/building and structure etc.:- Licensee shall pay compensation to the recorded land owner or his/her successor in interest for damage caused to their crops/trees/buildings and structures etc. The committee comprising of ADM, District Forest Officer and EE (PWD) shall make an assessment in this regard and furnish the report to DM within 15 days from the date of requisition from the Collector. ADM will be the convener of the said committee. 3. Areas with Row constraints: When laying transmission lines in areas with RoW constraints, various technologies can be considered to optimize the use of space. These technologies are outlined in the Central Electricity Authority (Technical Standards for Construction of Electrical Plants and Electric Lines) Regulations, 2022. Some options include: steel pole structures, narrow-based lattice towers, multi-circuit and multi-voltage towers, single-side stringing with lattice or steel poles, XLPE underground cables, Gas Insulated Lines (GIL), compact towers with insulated cross arms, voltage Source Converter (VSC) based High Voltage Direct Current (HVDC) systems, and more. A cost matrix comparing these technologies is attached at Annex-II for reference by implementing agencies. This matrix can help them choose the most cost-effective option for each project. 4. Landowner identification: During the check survey conducted at the execution stage, the names of landowners whose property falls within the transmission line's Right-of-Way (RoW) will be documented. This process shall adhere to the Regulation 84(8) of the Central Electricity Authority (Technical Standards for Construction of Electrical Plants and Electric Lines) Regulations' 2022'. The licensee shall provide details of affected land/area through which transmission line passes. The DM concerned shall finally determine the compensation and its recipients and forward the statement to the licensee within a period of 30 days from the date of the recent requisition from the licensee. 5. The licensee shall then pay the compensation to the recorded land owner or his/her successor in interest preferably by NEFT/RTGS within 10 days. 6. In case of any dispute with respect to the amount of compensation, the provisions of section 16 of the Telegraph Act, 1885 shall apply. Note 1. The above compensation amount will be payable only for transmission lines supported by a tower base of 66 KV and above, and not for sub-transmission and distribution lines below 66 KV. Note 2. "Area under the Tower" means "the tower base area enclosed by the four legs of the tower at ground level, plus an additional one (1) meter extension on each side" Note 3. The Licensee as well as all stakeholders shall follow the Standard Operating Procedure (SOP) (Annexure III) laid down by the Ministry of Power, Gol vide letter F.No.3/4/2016-Trans-Part (4) dated 14.06.2024 on the subject "Guidelines for payment of compensation in regard to Right of Way (ROW) for transmission Lines" By Order and in the Name of Lt.
