Core Purpose

The Government of the National Capital Territory of Delhi issues comprehensive directions for air pollution control, superseding all earlier orders, for compliance from 1st November to 28th February every year, under Section 5 of the Environment (Protection) Act, 1986.

Detailed Summary

The Government of the National Capital Territory of Delhi (GNCTD) has issued new directions for air pollution control, effective annually from 1st November to 28th February, or as specified, superseding all previous orders. These directions are issued under Section 5 of the Environment (Protection) Act, 1986, read with Notification No. S.O. 667(E) dated 10.09.1992, by the Ministry of Home Affairs. The context highlights severe air pollution in Delhi, with the entire NCT of Delhi declared an Air Pollution Control Area under Section 19 of the Air (Prevention and Control of Pollution) Act, 1981, vide notification dated 20.02.1987. The Commission for Air Quality Management (CAQM) in National Capital Region and Adjoining Areas issued a revised Graded Response Action Plan (GRAP) via Order dated 21.11.2025, categorizing air quality into four stages. Air Quality Index (AQI) data for 2023-26 indicates deterioration from 1st November to 15th February, with median AQI between 312-342 and maximum AQI between 461-494. The new directions cover three main areas: I. Vehicle Pollution Control, mandating fuel dispensing only with a valid Pollution Under Control Certificate (PUCC) year-round, restricting entry of non-BS-VI vehicles registered outside Delhi from 1st November to 31st January (with exemptions for CNG/Electric, emergency vehicles), doubling parking charges from 1st November to 28th February (except DMRC parking), and implementing staggered office timings (MCD: 8:30 AM-5:00 PM, GNCTD: 10:00 AM-6:30 PM) from 1st November to 28th February. Additionally, Government and Private Offices in NCT of Delhi must reduce physical staff strength by 50% from 1st November to 31st January, with exemptions for essential services. II. Dust Pollution Control, imposing a ban on dust-generating demolition and outdoor civil construction (except essential public infrastructure) from 1st November to 31st January, and a complete ban on construction and demolition activities (except urgent government projects/emergencies) from 10th December to 20th January. Entry of vehicles carrying construction materials into NCT of Delhi is restricted from 10th December to 20th January (with exemptions). Commercial high-rise buildings (>3,000 sq. m, G+5 and above) must install anti-smog guns (per Annexure-1) or mist systems (per Annexure-2) by 15th August, operational year-round except May 1st to September 15th. Mist systems are also mandatory for under-construction sites (>1,000 sq. m). III. Prohibition on Open Burning, making Resident Welfare Associations (RWAs), institutions, and establishments responsible for preventing open burning within their premises and providing clean heating alternatives. Violations of these directions are liable for penal action under Section 15 of the Environment (Protection) Act, 1986, including prosecution and Environmental Compensation (EC), with more stringent GRAP measures prevailing if invoked by CAQM.

The throw distance (horizontal) should be 75 to 100 meters. d. The consumption of water shall not exceed 1000-1200 litres/hour and 10000 litres in a day with 8 hours of running. e. The sound decibels due to use of air blower shall be reduced to minimum. f. A suitable air quality monitor equipment should be integral to the overall system. g. The size of the water droplets coming out of the nozzle should be further reduced to have a mist effect. h. The equipment should be used intermittently during the periods of maximum pollution between 6:30 am to 9:30 am, 5:30 pm to 8:30 pm and 1:30 am to 4:30 am rather than running it throughout the day. i. In addition, the equipment should preferably run in bursts of a few minutes between intermittent halt periods. This will facilitate better coagulation of suspended impurities and will also reduce electricity and water consumption. j. Prescribed number of Anti-Smog Guns to be deployed on High -Rise Buildings in proportion to the built-up area is given below: Built up area | Number of Anti-Smog Guns to be deployed Less than 10000 sqm | At least 03 10001-15000 sqm | At least 04 15001-20000 sqm | At least 05 20000-25000 sqm | At least 06 k. Thereafter for each 5000 sqm additional antismog gun would be installed. l. Water used for Anti-Smog Guns should be treated water. Annexure-2 Suggested technical specification for used by NDMC and DDA for mist sprays for illustrative purposes (departments to customize specifications and explore cost effective technologies available with similar specifications giving desired output, as per their area jurisdiction): • Supplying, installation, testing and commissioning of Reverse Osmosis (RO) system shall have a capacity of 2000 litres per hour (LPH) (and output water TDS upto 50 PPM) and be equipped with all necessary components, including high-pressure pumps, membranes, filters, and associated piping for efficient operation. • The system will include a high- pressure pump capable of delivering the required pressure for optimal membrane performance, typically around 10-15 bar, with corrosion- resistant materials to handle water conditions. • The RO membranes shall be of high quality, TFC (Thin Film Composite) type, with a recovery rate of up to 75%, designed to remove dissolved solids, contaminants, and impurities, ensuring high-quality permeate water. • The system will feature a pre-treatment stage with multi-media and activated carbon filter store move sediment, chlorine, and organic matter, ensuring the longevity of the membranes. It shall also include an anti-scalant dosing system to prevent membrane fouling. Post-treatment options, such as UV sterilization or ozonation, may be provided for disinfection purposes. • The system shall be fully automated with a control panel for real-time monitoring, pressure gauges, flow meters, and safety features like low-pressure and high- pressure switches, ensuring smooth operation and protection of the components. The frame should be made from stainless steel for durability and corrosion resistance, and the entire system must be easy to maintain, energy-efficient, and compliant with international water treatment standards. Including supplying and fixing of all suitable accessories for installation etc. as required.
