Odisha Gramya Bank, by notification No. CH/HRD/831/2024-25 dated 19th October 2024, exercising powers under section 30 read with sub-section (1) of section 17 of the Regional Rural Banks Act, 1976 (21 of 1976), and acting through its Board of Directors after consultation with Indian Overseas Bank (the Sponsor Bank) and the National Bank for Agriculture and Rural Development (NABARD), and with the previous sanction of the Central Government, notified the "Odisha Gramya Bank (Officers & Employees) Service (Amendment) Regulations, 2024," effective from publication in the Official Gazette, amending the Odisha Gramya Bank (Officers and Employees) Service Regulations, 2010. Regulation 61(4) is substituted to cap Privilege Leave accumulation at not more than 270 days (except where leave applied for was refused), with encashment restricted to a maximum of 240 days. Regulation 67 is amended to add, after "retires from the service of the Bank" in the second proviso, the words "under the provisions of regulation 11"; to substitute the third proviso concerning retrenched employees' entitlement to payment equivalent to accumulated privilege leave emoluments (subject to regulation 61(4)); and to insert further provisos entitling officers/employees who voluntarily retire on or after 1st April 2018 (after due notice under regulation 27(1) and (2) of the Odisha Gramya Bank (Employees') Pension Regulations, 2018), who are compulsorily retired (including as punishment), or who resign under regulation 10(1), to payment equivalent to accumulated privilege leave emoluments, with resignees limited to half of accumulated leave up to a maximum of 120 days. The original 2010 Regulations were published under notification No. 46 dated 13th November 2010 and previously amended by notification No. 345 dated 31st December 2013 and notification No. 487 dated 12th December 2018. L.-33004/99 The Gazette of India CG-OR-E-23102024-258154 EXTRAORDINARY PART III-Section 4 PUBLISHED BY AUTHORITY No. 847] NEW DELHI, MONDAY, OCTOBER 21, 2024/ASVINA 29, 1946 6845 GI/2024 ODISHA GRAMYA BANK NOTIFICATION Bhubaneswar, 19th October, 2024 No. CH/HRD/ 831 /2024-25-In exercise of the powers conferred by section 30 read with sub-section (1) of Section 17 of the Regional Rural Banks Act, 1976 (21 of 1976), the Board of directors of Odisha Gramya Bank after consultation with Indian Overseas bank, being the Sponsor Bank and the National Bank for Agriculture and Rural Development and with the previous sanction of the Central Government, hereby makes the following regulations to further amend the Odisha Gramya Bank (Officers & Employees) Service Regulations,2010, namely: 1. (1) These Regulations may be called Odisha Gramya Bank (Officers & Employees) Service (Amendment) Regulations, 2024. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Odisha Gramya Bank (Officers and Employees) Service Regulations, 2010 (hereinafter referred to as said regulations), in the regulations 61 for sub-regulation (4), the following sub-regulation shall be substituted, namely:- "(4) Privilege Leave may be accumulated up to not more than 270 days, except where leave has been applied for and it has been refused: Provided that encashment of Privilege Leave shall be restricted up to a maximum of 240 days.” 3. In the said regulations, in regulation 67,— (a) In second proviso, after the words "retires from the service of the Bank", the words "under the provisions of regulation 11" shall be inserted; (b) For third Proviso, the following proviso shall be substituted, namely:- "Provided also that in respect of the employee where his services are terminated owing to retrenchment, he shall be eligible to be paid a sum equivalent to the emoluments for the period of privilege leave he had accumulated subject to sub-regulation (4) of regulation 61.” (c) After third proviso, the following provisos shall be inserted, namely,- "Provided also that where an officer or employee voluntarily retires from service on or after the 1st of April 2018, after giving due notice under sub-regulations (1) and (2) of regulation 27 of the Odisha Gramya Bank (Employees') Pension Regulations, 2018, he shall be eligible to be paid a sum equivalent to the emoluments for the period of privilege leave he had accumulated, subject to sub-regulation (4) of regulation 61. Provided also that where an officer or employee has been compulsorily retired including as a measure of punishment, he shall be eligible to be paid a sum equivalent to the emoluments of any period, subject to sub-regulation (4) of regulation 61. Provided also that where an officer or employee leaves or discontinues from service or resigns under the provisions of sub-regulation (1) of regulation 10, he shall be eligible to be paid a sum equivalent to the emoluments in respect of Privilege leave to the extent of half of such leave to his credit on the date of cessation of service, subject to a maximum of 120 days."
