No. JERC:28/2021) issued from Gurugram, in exercise of powers under Section 181 read with Sections 61, 63, 66 and 86 of the Electricity Act, 2003 (36 of 2003), Clause 5.3 of the Tariff Policy, 2016, and directions of the Supreme Court in Civil Appeal No. 1933 of 2022, notifies the JERC for the State of Goa and Union Territories (Generation, Transmission and Distribution Multi Year Tariff) (First Amendment) Regulations, 2023, amending the Principal Regulations of 2021 (published in Part III-Section 4, No. 110 of the Gazette of India dated 23rd March 2021), applicable for tariff determination up to 31st March 2025 and extending to Goa and the Union Territories of Andaman and Nicobar Islands, Lakshadweep, Dadra and Nagar Haveli and Daman and Diu, Puducherry, and Chandigarh; the amendment inserts a proviso after Regulation 8.3(b) fixing capital investment plan threshold limits for 66kV-and-above transmission schemes at Rs. 50 crore for Goa/Chandigarh/Dadra and Nagar Haveli and Daman and Diu and Rs. 25 crore for Puducherry, requiring schemes exceeding these thresholds to be executed through Tariff Based Competitive Bidding (TBCB), and directing the respective State Transmission Utility to frame implementing guidelines within three months, subject to Commission approval; the notification is signed by S.D. No. JERC: 28/2021 .—In exercise of the powers conferred under Section 181 read with Sections 61, 63, 66, 86 of the Electricity Act, 2003 (36 of 2003) and in pursuance to the Clause 5.3 of the Tariff Policy, 2016, and for the compliance of the directions issued by the Hon’ble Supreme Court in t he matter of Civil Appeal No. 1933 of 2022, and all other powers enabling it in this behalf, the Joint Electricity Regulatory Commission for the State of Goa and Union Territories (except Delhi), after previous publications, hereby amend its existing JERC (Generation, Transmission and Distribution Multi Year Tariff) Regulations, 2021 (hereinafter referred to as the Principal Regulations). Chapter 1: Pre liminary 1. Short Title, Commencement and Extent 1.1 These Regulations shall be called the Joint Electricity Regulatory Commission for the State of Goa and Union Territories (Generation, Transmission and Distribution Multi Year Tariff) (first amendment) Regulatio ns, 2023. 1.2 These Regulations shall be applicable for determination of tariff in all matters covered under these Regulations upto March 31, 2025, unless modified/extended. 1.3. These Regulations shall extend to the whole of the State of Goa and the Union Ter ritories of Andaman and Nicobar Islands, Lakshadweep, Dadra & Nagar Haveli and Daman & Diu, Puducherry and Chandigarh. 2. Amendment in Regulation 8 of the Principal Regulation: The following provision shall be added after Regulation 8.3 (b) of the Principal R egulation: Provided that the Capital Investment Plan of the Transmission System of 66kV & above voltage level shall take into account schemes costing below the threshold limit as given below: State/UT Threshold Limit Goa/Chandigarh/ Dadra & Nagar Haveli and Daman & Diu i.e., (DNHDD) Rs. 50 Crore Puducherry Rs. 25 Crore Provided further that the Capital Investment Plan of Transmission System of 66kV & above voltage level exceeding the threshold limit as mentioned in the above proviso shall be done throug h Tariff Based Competitive Bidding (TBCB). Further, the respective State Transmission Utility shall frame the said guidelines within three months from the issue of this notification and notify the same after approval of this Commission. S.D.
