Detailed Summary

Saurashtra Gramin Bank, in exercise of powers under section 30 read with sub-section (1) of section 17 of the Regional Rural Banks Act, 1976 (21 of 1976), after consultation with State Bank of India as Sponsor Bank and the National Bank for Agriculture and Rural Development, and with the previous sanction of the Central Government, made the Saurashtra Gramin Bank (Officers And Employees) Service (Amendment) Regulations, 2024, amending the Saurashtra Gramin Bank (Officers and Employees) Service Regulations, 2010, effective from the date of publication. Sub-regulation (4) of regulation 61 is substituted to cap accumulated Privilege Leave at 270 days, except where leave applied for was refused, with encashment restricted to a maximum of 240 days. Regulation 67 is amended: the second proviso is extended to reference retirement under regulation 11; the third proviso is substituted to provide payment of accumulated privilege leave emoluments (subject to the regulation 61(4) cap) to employees retrenched; and new provisos are inserted covering employees who voluntarily retire on or after 1 April 2018 under regulation 27(1)/(2) of the Saurashtra Gramin Bank (Employees') Pension Regulations, 2018, employees compulsorily retired (including as punishment), and employees who resign under regulation 10(1), the latter capped at half of accumulated leave up to a maximum of 120 days. The 2010 Regulations were originally published vide notification no. 229 dated 13/09/2010 and previously amended vide notification no. 468 dated 06/12/2018 and notification no. 328 dated 11/08/2021. L.-33004/99 The Gazette of India CG-GJ-E-23082024-256588 EXTRAORDINARY PART III—Section 4 PUBLISHED BY AUTHORITY No. 645] NEW DELHI, THURSDAY, AUGUST 22, 2024/SHRAVANA 31, 1946 5371 GI/2024 SAURASHTRA GRAMIN BANK NOTIFICATION Rajkot, the 8th August, 2024 SGB/HO/PER/19638/2024.—In exercise of the powers conferred by section 30 read with sub-section (1) of section 17 of the Regional Rural Banks Act, 1976 (21 of 1976), the Board of Directors of Saurashtra Gramin Bank after consultation with State Bank of India, being the Sponsor Bank and the National Bank for Agriculture and Rural Development and with the previous sanction of the Central Government, hereby makes the following regulations to further amend the Saurashtra Gramin Bank (Officers & Employees) Service Regulations, 2010, namely:- 1. (1) These regulations may be called Saurashtra Gramin Bank (Officers And Employees) Service (Amendment) Regulations, 2024. (2)They shall come into force on the date of their publication in the Official Gazette. 2. In the Saurashtra Gramin Bank (Officers and Employees) Service Regulations, 2010 (hereinafter referred to as said regulations), in the regulations 61 for sub-regulation (4), the following sub-regulation shall be substituted namely:- "(4)Privilege Leave may be accumulated up to not more than 270 days, except where leave has been applied for and it has been refused: Provided that encashment of Privilege Leave shall be restricted up to a maximum of 240 days." 3. In the said regulations, in regulation 67,- (a) In second proviso, after the words "retires from the service of the Bank", the words "under the provisions of regulation 11" shall be inserted; (b) For third proviso, the following provisos shall be substituted, namely:- "Provided also that in respect of the employee where his services are terminated owing to retrenchment, he shall be eligible to be paid a sum equivalent to the emoluments for the period of privilege leave he had accumulated subject to sub-regulation (4) of regulation 61." (c) After third proviso, the following provisions shall be inserted, namely,- "Provided also that where an officer or employee voluntarily retires from service on or after the 1st of April 2018, after giving due notice under sub-regulations (1) and (2) of regulation 27 of the Saurashtra Gramin Bank (Employees') Pension Regulations, 2018, he shall be eligible to be paid a sum equivalent to the emoluments for the period of privilege leave he had accumulated, subject to sub-regulation (4) of regulation 61. Provided also that where an officer or employee has been compulsorily retired including as a measure of punishment, he shall be eligible to be paid a sum equivalent to the emoluments of any period, subject to sub-regulation (4) of regulation 61. Provided also that where an officer or employee leaves or discontinues from service or resigns under the provisions of sub-regulation (1) of regulation 10, he shall be eligible to be paid a sum equivalent to the emoluments in respect of privilege leave to the extent of half of such leave to his credit on the date of cessation of service, subject to a maximum of 120 days."
