Detailed Summary

The Ministry of Road Transport and Highways, vide S.O. 5601(E) dated 27th December 2024 (F. No. NHAI/RO(MP)/Sandalpur-Badi/LA/2023/3D), records that pursuant to its earlier notification S.O. 498(E) dated 05/02/2024 declaring intent under sub-section (1) of section 3A of the National Highways Act, 1956 (48 of 1956) to acquire land for building (widening/four-laning etc.), maintenance, management and operation of National Highway No. 146B (Budhni-Badi section) between Km. 135.200 and Km. 150.712 in Raisen district, Madhya Pradesh, whose substance was published in "Raj Express" and "Free Press" both dated 16th February 2024, and after the Competent Authority considered and settled objections filed under section 3-C and submitted its report under sub-section (1) of section 3D, the Central Government, in exercise of powers under sub-section (1) of section 3D, declares that the scheduled land totalling 6.913 hectares across villages including Amrawad Kalan, Digwad, Nanpon and Badi Khurd shall be acquired for the stated purpose, and further, under sub-section (2) of section 3D, declares that upon publication of this notification the land shall vest absolutely in the Central Government free from all encumbrances. No. 498(E) Dated 05/02/2024, published in the Gazette of India, Extraordinary, Part II, Section 3, Sub-section (ii) issued under sub -section (1) of section 3A of the National Highway Act, 1956 (48 of 1956) (hereinafter referred to as the said Act), the Central Government declared its intension to acquire the land specified in the Schedule annexed to the said notification for building (widening/four -laning, etc.), maintenance, management and operation of National Highway No. 146B (Budhni - Badi section) in the stretch of land from Km. 135.200 to Km. 150.712 in the district of RAISEN in the state of MADHYA PRADESH. And whereas the substance of the said notification has been published in “Raj Express” and “Free Press” both dated 16th February, 2024; under sub -section (3) of section 3A of the said Act; And whereas the Competent Authority has received objections filed under Section 3 -C, considered and settled the same appropriately; And whereas, in pursuance of sub -section (1) of section 3D of the said Act, the competent authority has submitted its report to the Central Government; Now, therefore, upon receipt of the said report of the competent authority and in exercise of the powers conferred by the sub -section (1) of section 3D of the said Act, the Central Government hereby declares that the land specified in the said Schedule should be acquired for the aforesaid purpose; And further, in pursuance of sub -section (2) of section 3D of the said Act, the Central Government hereby declares that on publication of this notification in the Official Gazette, the land specified in the said Schedule shall vest absolutely in the Central Government, free from all encumbrances.
