The Ministry of Women and Child Development, through G.S.R. 75(E) dated 30th January, 2026, has published the National Commission for Protection of Child Rights (Amendment) Rules, 2025. These rules, coming into force upon publication in the Official Gazette, amend the National Commission for Protection of Child Rights Rules, 2006. Key amendments include: in rule 5, the Member-Secretary is now vested with the power to incur expenditure up to a maximum of five lakh rupees for day-to-day affairs, and the terms "officers and other employees" are replaced with "officer and officials." Rule 6 is amended to state that vacancies shall be filled "expeditiously by the Central Government" instead of "by nomination within ninety days." A new rule 6C is inserted, allowing the Selection Committee to set up a screening committee, consisting of a Joint Secretary of the Ministry of Women and Child Development and two eminent child rights persons (one woman expert), to shortlist eligible candidates for the Selection Committee. Rule 7 is amended to specify that for retired government servants or those from semi-government bodies, public sector undertakings, or recognized research institutions, the salary plus pension/terminal benefits shall not exceed the last pay drawn at retirement. Rule 8 is substituted to state that the Chairperson and Members are entitled to allowances as determined by the Central Government at rates admissible to equivalent level Central Government officers. Rule 9 is omitted. Rule 10 is substituted to provide leave as per the Central Civil Services (Leave) Rules, 1972. Rule 15 is substituted to entitle the Chairperson, Members, and regular officers/officials to medical treatment and hospital facilities applicable to Central Government servants. Rule 18(5) specifies that the quorum for a Commission meeting shall be half of its actual strength. Rule 24 is amended to grant the Chairperson all powers relating to financial transactions, except those requiring Central Government approval, and the Chairperson shall have powers to decide the requirement of engaging consultants in accordance with General Finance Rules. The principal rules were previously amended by G.S.R 450 (E) dated 31st July, 2006, G.S.R. 517(E) dated 29th June, 2012, G.S.R. 207(E) dated 24th March, 2014, G.S.R. 315 (Ε) dated 6th May, 2014, and G,S.R 613(E) dated 3rd September, 2021.

L.-33004/99 The Gazette of India CG-DL-E-31012026-269717 EXTRAORDINARY PART II-Section 3-Sub-section (i) PUBLISHED BY AUTHORITY No. 74] NEW DELHI, FRIDAY, JANUARY 30, 2026/MAGHA 10, 1947 657 GI/2026 MINISTRY OF WOMEN AND CHILD DEVELOPMENT NOTIFICATION New Delhi, the 30th January, 2026 G.S.R. 75(E).— In exercise of the powers conferred by sub-section (1) read with clauses (a) to (d) of sub- section (2) of section 35 of the Commissions for Protection of Child Rights Act, 2005 (4 of 2006), the Central Government hereby makes the following rules further to amend the National Commission for Protection of Child Rights Rules, 2006, namely: - 1. (1) These rules may be called the National Commission for Protection of Child Rights (Amendment) Rules, 2025. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the National Commission for Protection of Child Rules, 2006 (hereinafter referred to as the principal rules), in rule 5, - (a) under the heading 'Power and duties of the Member-Secretary', for the brackets, figure and words "(1) The Member- Secretary shall", the words "The Member- Secretary shall" shall be substituted; (b) for clause (xi), the following clause shall be substituted, namely: - "(xi) be vested with the power to incur expenditure up to a maximum of five lakh rupees towards the administering and management of the day-to-day affairs of the Commission.”; (c) in clause (xii), for the words "officers and other employees", the words "officer and officials"; shall be substituted. 3. In the principal rules, in rule 6, in sub-rule (6), for the words "by nomination within ninety days from the date of occurrence of such vacancy", the words "expeditiously by the Central Government” shall be substituted.; 4. In the principal rules, for rule 6C, the following rule shall be substituted, namely: - “6C. (1) The Selection Committee may set up a screening committee to assist it in scrutinising applications and prepare a list of candidates fulfilling the required criteria in respect of qualifications for shortlisting eligible candidates. (2) The screening committee consisting of a Joint Secretary of the Ministry of Women and Child Development and two eminent persons from child rights field, out of which one shall be a woman expert. (3) The Selection Committee constituted under rule 6B, shall consider only such candidates which are scrutinised and shortlisted by the screening committee. Explanation. - For the purposes of this rule, it is clarified that the screening committee shall aid and supplement the process adopted by the Selection Committee and not replace the role of the Selection Committee.". 5. In the principal rules, in rule 7, - (a) in sub-rule (1), for the proviso, the following proviso shall be substituted, namely: - "Provided that where the Chairperson or any Member is a retired Government servant or has retired from a Semi- Government body or public sector undertaking or recognised research institution, the salary payable together with the pension or pensionary value of the terminal benefits, or both, received by the person shall not exceed the last pay drawn at the time of such retirement."; (b) in sub-rule (2), for the words "officers and other employees", the words "officer and officials" shall be substituted. 6. In the principal rules, for rule 8, the following rule shall be substituted, namely: "8. Allowances. The Chairperson and Members shall be entitled to allowances as determined by the Central Government from time to time, at the rates admissible to officers of the equivalent level of the Central Government.”. 7. In the principal rules, rule 9, shall be omitted. 8. In the principal rules, for rule 10, the following rule shall be substituted, namely: – "10. Leave. -The Chairperson and Member shall be entitled to leave as per the Central Civil Services (Leave) Rules, 1972.". 9. In the principal rules, in rule 11, in sub-rule (3), for the words "any officer or other employee", the words "employee and officials" shall be substituted. 10. In the principal rules, in rule 12, for sub-rule (2), the following rule shall be substituted, namely: - "(2) The Chairperson and Member shall be his own controlling officer in respect of his bills relating to traveling allowances and daily allowances and for other employees, a schedule of controlling officers shall be specified by the Chairperson.". 11. In the principal rules, in rule 13, for the words "may be determined by the Government of India", the words "applicable to the equivalent officers of the Central Government" shall be substituted. 12. In the principal rules, for rule 15, the following rule shall be substituted, namely: - "15. Facility for medical treatment. – The Chairperson, Members and all regular officers or official" shall be entitled to medical treatment and hospital facilities as applicable to the Central Government servants.”. 13. In the principal rules, in rule 18, for sub-rule (5), the following sub-rule shall be substituted, namely: – "(5) The requisite number to form a quorum for meeting of the Commission in respect of its business shall be half of actual strength of the Commission". 14. In the principal rules, in rule 24, - (a) for sub-rule (2), the following sub-rule shall be substituted, namely: – "(2) The Chairperson shall have all powers relating to financial transaction of the Commission, except in cases, which require prior approval of the Central Government.”; (b) in sub-rule (4), for the words "any Member or the Member-Secretary:" the words, "the Member Secretary." shall be substituted; (c) in sub-rule (4), the proviso shall be omitted; (d) for sub-rule (5), the following sub-rule shall be substituted, namely: – "(5) The Chairperson shall have powers to decide the requirement of engaging consultant for a specific purpose in accordance with the provisions of General Finance Rules and relevant guidelines on the subject issued by the Central Government from time to time.".
