By notification S.O. 4272(E) dated 29 September 2023, the Ministry of Road Transport and Highways, in exercise of powers under sub-sections (1) and (2) of Section 3D of the National Highways Act, 1956 (48 of 1956), declared that the land described in the annexed Schedule shall be acquired for building (four-laning), maintenance, management, and operation of the proposed Bangalore-Chennai Expressway (NHNE-7) on the stretch from Km. 0/000 to Km. 11/450 in Bangalore Rural district, Karnataka, and that such land shall vest absolutely in the Central Government free from all encumbrances upon publication. This follows an earlier declaration of intent under notification S.O. No. 2860(E) dated 30 June 2023, issued under sub-section (1) of Section 3A of the Act, whose substance was published in "Samyuktha Karnataka" (Kannada) and "Times of India" (English) on 18 July 2023 under sub-section (3) of Section 3A; objections received were considered and disallowed by the competent authority, which then submitted its report under sub-section (1) of Section 3D. The Schedule lists 10 parcels of predominantly private (dry, wet, and NAK-classified) land and one government-owned pond, by survey/plot number and named owners/interested persons, across the villages of Vadigehalli, Karibeerana Hosahalli, Vagata, Jinnagara, and Chimandahalli in Hoskote Taluk, Bangalore Rural district, Karnataka, for a total acquired area of 1.7549 hectares. No. 2860(E) Dated: 30/06/2023 , published in the Gazette of India, Extraordinary, Part II, Section 3, Sub -section (ii) is sued under sub -section (1) of section 3A o f the National Highway Act, 1956 (48 of 1956) (hereinafter referred to as the said Act), the Central Government declared its intention to acquire the land specified in the Schedule annexed to the said notification for building (four -laning, etc.), maintena nce, management and operation of Proposed Bangalore -Chennai Expressway NHNE -7 in the stretch of land design Chainnage Km. 0/000 to Km. 11/450 in the district of Bangalore Rural in the state of KARNATAKA . And whereas the substance of the said notification has been published in “Samyuktha Karnataka” in Kananda Language and “Times of India” in English Language both dated 18/07/2023; under sub -section (3) of section 3A of the said Act; And whereas objections have been received and the same have been consider ed and disallowed by the competent Authority; And whereas, in pursuance of sub -section (1) of section 3D of the said Act, the competent authority has submitted its report to the Central Government; Now, therefore, upon receipt of the said report of the c ompetent authority and in exercise of the powers conferred by the sub -section (1) of section 3D of the said Act, the Central Government hereby declares that the land specified in the said Schedule should be acquired for the aforesaid purpose; And further, in pursuance of sub -section (2) of section 3D of the said Act, the Central Government hereby declares that on publication of this notification in the Official Gazette, the land specified in the said Schedule shall vest absolutely in the Central Government , free from all encumbrances.
