The objections or suggestions which may be received from any person with respect to the said draft rules before the expiry of the period a foresaid will be considered by the Central Government; 3. DRAFT RULES 1. Short title and commencement - (1) These rules may be called as the Central Motor Vehicles (……………Amendment) Rules, 2023. (2) Save as otherwise provided in these rules, they shall come into force on the da te of their final publication in the Official Gazette. 2 In the Central Motor Vehicles Rules, 1989 (herein after referred as the said rules), after the rule 126 -D, following rule shall be inserted, namely: - “126 -E. Bharat New Car Assessment Progra mme or BNCAP: - The Bharat New Car Assessment Programme shall be applicable on the Type Approved vehicles of category M1, manufactured or imported in the country as specified in the Programme made by the Central Government in this regard. (1) Under BNCAP, on and from the 1st day of October 2023, the Manufacturers or Importers of motor vehicles, to submit an application in FORM 70 -A, to the agency designated by the Central Government, hereinafter referred to as “Designated Agency”, in accordance with such pr ocedure as may be decided by the Central Government, to get their motor vehicle star rated in accordance with the Automotive Industry Standard (AIS) -197, as amended from time to time. The cost of the motor vehicle for the purpose of assessment and the cost of assessment shall be borne by the respective Manufacturer or Importer. (2) The motor vehicles for the purpose of assessment shall be randomly drawn by an authorized representative of the Designated Agency, from the premises of the Manufacturer, Importer , or authorized dealer of the Manufacturer or Importer, as per the relevant provisions of AIS -197. (3) The Designated Agency shall select any of the testing agencies, referred to in Rule 126 of the Central Motor Vehicles Rules, 1989, for the assessment of the vehicles selected in sub -rule (2). The Manufacturer or Importer shall send the selected vehicles to the selected Testing Agency. (4) The Testing Agency shall evaluate the vehicles as per AIS -197 and submit the Assessment Report to the Designated Agen cy as per FORM 70 -B. (5) On examination and approval of the Assessment Report, the star rating of the vehicle shall be uploaded on the designated portal by the Designated Agency. Provided that n othing in this rule shall be applicable to vehicles exempted b y the Central Government from Type Approval requirements as per Rule 126 or Conformity of Production requirements of the Central Motor Vehicle Rules, 1989.” 3.
