I. (3).―In exercise of the powers conferred by sub -section (1) and clause (xxi) of sub-section (2) of section 97 read with sub -section (2A) of that section and clause (a) of sub -section (2) of section 17 of the Employees’ State I nsurance Act, 1948 (34 of 1948) and in supersession of the Employees’ State Insurance Corporation Additional Commissioner Recruitment Regulations, 2017, except as respects things done or omitted to be done before such supersession, the Employees’ State Ins urance Corporation hereby makes, with the approval of the Central Government, the following regulations, regulating the method of recruitment to the post of Additional Commissioner in the Employees’ State Insurance Corporation, namely: - 1. Short title an d commencement.― (1) These regulations may be called the Employees’ State Insurance Corporation (Additional Commissioner) Recruitment Regulations, 2024. (2) They shall come into force on the date of their publication in the Official Gazette. 2. Number of posts, classification, level in pay matrix or pay scale.― The number of post, their classification, level in the pay matrix or pay scale attached thereto , shall be as specified in columns (2) to (4) of the Schedule annexed to these regulations. 3. Method of recruitment, age - limit, qualifications, etc.― The method of recruitment, age -limit, qualifications and other matters relating thereto shall be as specified in columns (5) to (13) of the said Schedule. 4. Disqualification.― No person, ― (a) who has entered into or contracted a marriage with a person having a spouse living; or (b) who, having a spouse living, has entered into or contracted a marriage with any person; shall be eligible for appointment to the said post: Provided that t he Chairman of the Employees’ State Insurance Corporation may, if satisfied that such marriage is permissible under the personal law applicable to such person and to the other party to the marriage and that there are other grounds for so doing, exempt any person from the operation of this regulation. 5. Power to relax.― Where the Director General of the Employees’ State Insurance Corporation is of the opinion that it is necessary or expedient so to do, he may with the approval of Chairman of the Employees’ State Insurance Corporation after taking prior approval of the Central Government, by order, for reasons to be recorded in writing and in consultation with the Union Public Service Commission, relax any of the provisions of these regulations, with respe ct to any class or category of persons. 6. Savings.― Nothing in these regulations shall affect reservation, relaxation of age -limit and other concessions required to be provided for the Scheduled Castes, the Scheduled Tribes, ex -Servicemen and other spec ial categories of persons in accordance with the orders issued by the Central Government from time to time, in this regard. By promotion: Regional Director Grade A or Director in Level 13 in the Pay Matrix (Rs.1,23,100 -2,15,900) with two years regular service in the grade and having completed mandatory training program for promotion to the post of Additional Commis sioner as conducted by the Employees State Insurance Corporation from time to time. Note 1: Where juniors who have completed their qualifying or eligibility service are being considered for promotion, their seniors shall also be considered provided they a re not short of the requisite qualifying or eligibility service by more than half of such qualifying or eligibility service or two years, whichever is less, and have successfully completed their probation period for promotion to the next higher grade along with their juniors who have already completed such qualifying or eligibility service. By deputation (including short -term contract): Officers of Central Government or State Governments or Union territory Administrations or public sector undertakings or statutory or autonomous bodies or recognised Universities/ institutes/ research institutions: a)(i) holding analogous post on regular basis in the parent cadre or Department; or (ii) with two year’s regular servic e in post in Level 13 in the pay matrix (Rs. 1,23,100 -2,15,900) or equivalent in the parent cadre or department and (b) possessing the following educational qualifications and experience: (i) Bachelors Degree from a recognised University/Institute; and (ii) thirteen years experience in financial or administrative matters or dealing with social security scheme or labour law. Note 1: The period of deputation including the period of deputation in another ex -cadre post held immediately preceding th is appointment in the same or some other organisation/ Department of the Central Government shall ordinarily not exceed five years. The Maximum age -limit for appointment by deputation shall be not exceeding 56 years as on the last date of receipt of applic ations. Note 2: The Departmental officers in the feeder category who are in the direct line of promotion shall not be eligible for consideration for appointment on deputation. Similarly, the deputationists shall not be eligible for consideration for appoi ntment by promotion. If a Departmental Promotion Committee exists, what is its composition. Circumstances in which Union Public Service Commission to be consulted in making recruitment. (12) (13) Departmental Promotion Committee (for considering prom otion) consisting of: - (1) Chairman or Member, Union Public Service Commission - Chairman; (2) Secretary, Ministry of Labour and Employment - Member; (3) Director General , Employees’ State Insurance Corporation. – Member.
