Form of application. — (1) Every application for compounding of an offence specified under sub- section (1) of section 53A of the Indian Ports Act 2025 (hereinafter referred to as the said Act), shall be made in Form-A, annexed to this notification. (2) The application shall be signed by the applicant or by an authorised representative duly authorised for that purpose. 2. Manner of making application. — (1) The application in Form-A shall be submitted,- (a) physically, at the office of the conservator; or (b) electronically, through the online system or portal specified by the Central Government for this purpose. (2) Every application submitted physically shall be accompanied by self-attested copies of documents specified by the conservator and the receiving office shall issue an acknowledgement indicating the date of receipt. (3) Every application submitted electronically shall include scanned copies of the documents referred to in sub-paragraph (2) and the system shall generate an electronic acknowledgement of the receipt. (4) An application shall be considered to have been duly made only upon the issuance of such acknowledgement. (5) The applicant shall retain a copy of the acknowledgement and produce it before the conservator if so required, for verification. 3. Processing of application. — (1) Upon receipt of the application, the conservator shall verify- (a) that the offence is compoundable under sub-section (1) of section 53A of the said Act; (b) that the application is complete; and (c) that proof of payment of the compounding amount has been furnished. (2) Where the application is found to be incomplete in respect of form or documents, the applicant may be required to furnish the missing particulars within fifteen days. 4. Compounding amount. (1) The sum payable for compounding of any offence shall be an amount equal to the fine specified for such offence under the First Schedule of the said Act, subject to the ceiling as provided in the proviso to sub-section (1) of section 53A of the said Act. (2) Nothing contained in this paragraph shall be construed to authorise compounding of any subsequent offence, as provided in the second proviso to sub-section (1) of section 53A of the said Act. 5. Manner of payment. (1) The compounding amount shall be paid for credit to the Central Government, as required by sub-section (1) of section 53A of the said Act, through,- (a) a treasury challan in the designated head of account; or (b) an online remittance through the authorised Government payment portal, as may be chosen by the applicant. (2) The applicant shall obtain an acknowledgement of payment issued,- (a) by the treasury; or (b) by the electronic system, and shall submit the same to the conservator, who is the compounding authority under sub-section (1) of section 53A of the said Act. 6.
