This notification, G.S.R. 150(E) dated 29th February 2024, issued by the Ministry of Road Transport and Highways, publishes draft rules to be called the Central Motor Vehicles (Amendment) Rules, 2024, proposed under sections 41, 109 and 110 of the Motor Vehicles Act, 1988 (59 of 1988), as required by sub-section (1) of section 212 of that Act, inviting objections and suggestions within thirty days to the Additional Secretary (MVL) at [email protected]; the draft rules amend the Central Motor Vehicles Rules, 1989 (principal rules published vide G.S.R. 590(E) dated 2nd June 1989) by inserting, after clause (id) of rule 2, new clauses defining "Category L2-5" as a three-wheeled motor vehicle combining a two-wheeler (Category L2) with a non-self-propelled rear module (Category L5), separable and usable as either configuration at a given time, along with "Category L2-5M" (for passenger carriage) and "Category L2-5N" (for goods carriage), classified per IS 14272:2011 as amended; it inserts a new sub-rule (9) in rule 50 requiring a single registration number and a single number plate (200 x 100 mm) for both L2-5 configurations; it inserts a new sub-rule (4) in rule 122 requiring the identification number, embossed, etched or punched, to conform to AIS 177:2021 as amended, pending corresponding Bureau of Indian Standards specifications under the Bureau of Indian Standards Act, 2016 (11 of 2016); and it inserts a new rule 125-P requiring that from 1st April 2024, all L2-5 category vehicles conform to AIS 177:2021 as amended; the notification is signed by Mahmood Ahmed, Additional Secretary, under file number RT-11036/104/2023-MVL; a note states the principal rules were published vide G.S.R. 590(E) dated 2nd June 1989.

L.-33004/99 The Gazette of India CG-DL-E-29022024-252494 EXTRAORDINARY PART II-Section 3-Sub-section (i) PUBLISHED BY AUTHORITY No. 138] NEW DELHI, THURSDAY, FEBRUARY 29, 2024 1434 GI/2024 MINISTRY OF ROAD TRANSPORT AND HIGHWAYS NOTIFICATION New Delhi, the 29th February, 2024 G.S.R. 150(E). -The following draft of certain rules further to amend the Central Motor Vehicles Rules, 1989, which the Central Government proposes to make in exercise of the powers conferred by section 41, 109, 110 of the Motor Vehicles Act, 1988 (59 of 1988), is hereby published as required by sub-section (1) of section 212 of the said Act for information of all persons likely to be affected thereby; and notice is hereby given that the said draft rules shall be taken into consideration after the expiry of thirty days from the date on which the copies of this notification as published in the Official Gazette, are made available to the public; Objections and suggestions to these draft rules, if any, may be sent to the Additional Secretary (MVL), email: [email protected] Ministry of Road Transport and Highways, Transport Bhawan, Parliament Street, New Delhi-110 001. The objections or suggestions which may be received from any person in respect of the said draft rules before the expiry of the aforesaid period will be considered by the Central Government. DRAFT RULES 1. (1) These rules may be called the Central Motor Vehicles (...... Amendment) Rules, 2024. (2) Unless and otherwise specified, these rules shall come into force on the date of their publication in the Official Gazette. 2. In the Central Motor Vehicles Rules, 1989 (hereinafter referred to as the principal rules), in rule 2, after clause (id), the following clause shall be inserted, namely: - "(ie) "Category L2-5" means a three wheeled motor vehicle, with a 2 wheeler-3 wheeler combination module, constructed in such a way that a two-wheeled vehicle of category L2 is combined with a non-self- propelled rear module unit. It can be separated or combined, as and when required; At any point of time, either a two-wheeler of Category L2 or a three-wheeled vehicle of Category L5 can only be used. (if) "Category L2 – 5 M” means a category L2-5 vehicle on account of its technical features intended to carry passengers; (ig) "Category L2 – 5 N” means a category L2-5 vehicle on account of its technical features intended to carry goods; Provided that category L2-5 vehicle may fall under the category of L2-5M for Passenger carrier or L2-5N Goods Carriage, depending on the weight of persons including driver for whom seating arrangements are provided is more than or less than the weight of goods carried. This shall be as per conditions specified in IS 14272:2011, as amended from time to time for L5 category of vehicles." 3. In the said rule, in rule 50 of the principal rules, after sub-rule (8), the following sub-rule shall be inserted, namely:- "9. In case of L2-5 category of vehicles, a single registration number shall be allotted for both the configurations, namely separated two-wheeled vehicle of L2 category or combined three wheeled vehicles of L5 category; and at any point of time there shall be only one registration mark displayed on the front and one on the rear of the vehicle irrespective of the configuration. Dimensions for plate for L2-5 category of vehicle shall be 200 X 100 mm." 4. In the said rule, in the rule 122 of the principal rules, after sub-rule (3), the following sub-rule shall be inserted, namely: - (4) In case of "L2-5" category of vehicles, the identification number including month and year of manufacture, embossed or etched or punched on it shall be in accordance with AIS 177:2021, as amended from time to time, till the corresponding Bureau of Indian Standards specification are notified under the Bureau of Indian Standards Act, 2016 (11 of 2016). 5. In the said rule, after rule 125-N following new rule 125-P shall be inserted, namely: - "125-P: On and after [1st April 2024], all "L2-5 Category" of vehicles shall conform to the requirements specified in AIS 177:2021, as amended from time to time, till the corresponding Bureau of Indian Standards specification are notified under the Bureau of Indian Standards Act, 2016 (11 of 2016).
