Detailed Summary

The Ministry of Ports, Shipping and Waterways, exercising powers conferred by sections 52(2), 53(1), 53(3), 54(1) read with section 106(2)(zm) to (zp) of the Inland Vessels Act, 2021 (24 of 2021), hereby makes rules to amend the Inland Vessels (Prevention and Containment of Pollution) Rules, 2022. These rules, called the Inland Vessels (Prevention and Containment of Pollution) Amendment Rules, 2025, come into force on their publication date in the Official Gazette. The amendments include inserting an Explanation in rule 2(1)(c) regarding the calculation of gross tonnage based on vessel length (>= 24 meters according to International Convention on Tonnage Measurement of Ships, 1969; < 24 meters according to Rule 3 of the Merchant Shipping (Tonnage Measurement of Ships) Rules, 1987). Rule 6 is amended by substituting "International Organisation of Standards" with "International Organisation for Standardisation". Rule 12 is amended: sub-rule (2) is substituted to mandate all inland vessels generating sewage to be provided with an appropriate sewage treatment plant, bio-digester, or holding tank of sufficient capacity; sub-rule (3) is substituted to exempt vessels on voyages of less than 60 minutes duration from the requirements of sub-rule (2). The draft rules were previously published vide notification G.S.R. 671(E) dated 29th October, 2024, as required under section 106(1) of the Act. No objections or suggestions were received by the Central Government on the draft rules. The principal rules were published vide notification G.S.R. 427(E) dated 7th June, 2022.

Whereas draft of the Inland Vessels (Prevention and Containment of Pollution) (First Amendment) Rules, 2024 were published, as required under sub-section (1) of section 106 of the Inland Vessels Act, 2021 (24 of 2021), vide notification of the Government of India in the Ministry of Ports, Shipping and Waterways number G.S.R. 671 (E), dated the 29th October, 2024, in the Gazette of India, Extraordinary, Part II, Section 3, Sub- section (i), dated the 29th October, 2024, inviting objections and suggestions from all persons likely to be affected thereby, before the expiry of the period of thirty days from the date on which copies of Gazette containing the said notification were made available to the public; And whereas copies of the said notification were made available to the public on 29th October, 2024; And whereas no objections and suggestions were received from the public in respect of the said draft rules by the Central government. Now, therefore, in exercise of the powers conferred bysub-section (2) of section 52, sub-sections (1) and (3) of section 53 and sub-section (1) of section 54 read with clauses (zm) to (zp) of sub-section (2) of section 106 of the Inland Vessels Act, 2021, the Central Government hereby makes the following rules to amend the Inland Vessels (Prevention and Containment of Pollution) Rules, 2022, namely. 1. (1) These rules may be called the Inland Vessels (Prevention and Containment of Pollution) Amendment Rules, 2025. (2) They shall come into force on the date of their publication in the Official Gazette. 2. In the Inland Vessels (Prevention and Containment of Pollution) Rules, 2022 (hereinafter referred to as the said rules), in rule 2, in sub-rule (1), in clause (c), the following explanation shall be inserted, namely: "Explanation. - For the purposes of this clause, gross tonnage of vessels of 24 meters orabove shall be calculated according to the International Convention on Tonnage Measurement of Ships, 1969, whereas gross tonnage of vessels less than 24 meters shall be calculated according to rule 3 of the Merchant Shipping (Tonnage Measurement of Ships) Rules, 1987, as amended from time to time;". 3. In rule 6, for the words "International Organisation of Standards", the words "International Organisation for Standardisation" shall be substituted. 4. In rule 12 of the said rules,- (a) for sub-rule (2), the following sub-rule shall be substituted, namely: - "(2) All inland vessels where sewage is generated are to be provided with an appropriate sewage treatment plant or bio-digester or holding tank of such capacity sufficient for the number of persons on board."; and (b) for sub-rule (3), the following sub-rule shall be substituted, namely: - "(3) Vessels engaged on voyages of less than 60 minutes duration may be exempted from the requirements contained in sub-rule (2).".
